penalty fare payment sent but ...

Hi,

My son and heir got a penalty fare which is not in dispute.

I sent back the form having filled in the credit card details on the back ..posted it and thought no more of it.

On friday a letter from RPSS arrived saying we had not paid and now its gone up to £40.

I called them and confirmed that the correspondance has not crossed and payment was never taken from our card.

Loathed to pay £40 but unless I can dig out proof of posting is there anything I can do ?

Fear that the proof of posting is going to be essential.
Though of course the extra charges do have to reflect the actual extra charges incurred. If it seems as though this is unlikely then you could try arguing the toss and asking them to provide evidence of how the late charges are calculated, or even just write saying "Kindly cash this cheque (for X = lesser figure) on the express and sole condition that it is accepted in final and complete settlement". (But the last course could lead them to send it back and pursue you further if they are feeling obstreperous!)
