Passengers Charter Claims

I am now making some claims, under the relevant train companies Passenger Charter, with a First Class All Line Rail Rover

The first to respond has been First ScotRail

Inverness - Euston sleeper, 90 minutes late
£114 of Rail Travel Vouchers
Based on 50% of a First Class Return fare
I've searched but cannot find a First Class Return fare between Inverness and Euston for £228 (excluding sleeper berth supplement)
Is it possible they have used the "cheaper" First Advance Single of £112.50

Have you tried phoning them and asking? Presumably there's a contact number given with their response for any inquiries?

I don't know, but that is beyond the Passengers Charter requirements so I wouldn't complain.

The Scotrail passenger's charter says

If you are delayed for more than one hour, you will receive travel vouchers to the value of 100% of that leg of the journey
Virgin only offer you 25% for an hour delay, and 100% for two hours.

Passengers Charters varies between passenger train companies
The compensation issued meets ScotRails, 100% for that leg of the journey (which is calculated as 50% of a return fare)

ScotRail had advised me they used the cheapest First Class return fare they could find for Inverness - Euston
However, they also conceded that it would not be valid on the sleeper, so will refer the claim for review

But you should only be compensated for that leg. So if your ticket cost £860 and you were doing (say) 4000 miles and were delayed 400 then you should arguably only get compensation on 1/10th of the price you paid, for example.

I bet Scotrail don't even get £114 revenue from your ticket!

if you want to be refunded £319 then I think that's just absurd.

I can see the ALR being abolished if TOCs are forced to pay out crazy sums. In fact it would be a profit making exercise to travel constantly on delayed trains on ALRs if that was the case!!

£114 for a 90 min delay is very generous and by rejecting it I hope they review it and decide it was too generous. Sorry!

Very interesting, I wonder if you could recompensate yourself for the entire cost of the All Line Rover if you stumbled into a large enough number of delays along your journey.

I'd imagine so. You wouldn't even need to "stumble" upon any delays if you just kept an eye on TOC websites for farces as most have live update type pages.

I was very surprised to find that the compensation is calculated as 50% of the return fare, rather than the proportion of that day, mileage, or some other calculation (the same as season tickets)

What this does mean though is that if a customer purchases a First Class Single then they are compensated at a different rate and would not be FULLY compensated
Equally, the cost of the sleeper berth is not included either

ScotRail have confirmed that they used the cheapest SINGLE fare between Inverness and London, but that it would not be valid on the sleeper
I am more than happy at the compensation they have offered!
I would have been happy at £50 (each days cost was £74)

Although passengers may claim the compensation, not all may do so
Presumably ScotRail then send this cost back to the train lease company and/or operator

Just out of interest, what proof do you need that you travelled on a delayed train? Do you have to get something from the staff at the time, or just claim afterwards?
If the train is already delayed when you get on, do you still get compensation?

I suppose that if I had a spare day on a rover with nothing better to do, I could spend the day trying to get onto trains that will be cancelled or delayed. With the current industrial action this should be quite easy ;)

Why bother getting delayed? Have a normal day, take a web-accessible phone with you and just keep an eye on the TOC/Journeycheck/LDB websites and make a note of what delays occur on the patch you have validity for, photocopy said validity and send refund forms off to your hearts content...

Which could result in a criminal investigation potentially. Not all trains are shown on live departure boards in the event of delays. For example the other day there were problems with the ECML at Grantham and GC terminated a London train at York, it then ran back to Sunderland forming a different northbound service around 1 hour late, however LDB showed this train simply as cancelled throughout. If someone put in a claim claiming the train didn't run at all, then it would be asked why didn't they see the train in the platform, and why didn't they see that on the screens it showed the train as delayed and not cancelled.

Do you actually feel that you deserve this money for your delay ? because being an enthusiast like the rest of us im sure a delay is nothing much to you obviously it is not 100% okay we all get slightly peeved but not by way to much.

Honestly I say this about people who claim anything cause I wonder is it a case of.....


"I feel I 100% honestly deserve this money due to the affect these events had on myself" so like a drunk driver hitting you or throwing up due to bad food.

Or

"Well if there stupid enough to offer then I don't see why I should pass the offer as money is money and it reduces the cost of my hobby" such as what is being assumed of you here.

I have never ever bothered putting in a claim, although I have often been inconveniently delayed, especailly by missed connections on return journeys in the evenings.

However, I have decided to give it a try and see what happens. I am not expecting to get much because I didn't pay much in the first place but at least it may refund my £1.50 tram fare that I had to pay.

Yesterday I was travelling from Leeds to Hucknall (Nottingham to Worksop line) and using a very cheap through AP ticket with NXEC and connections which only cost me £7.90.
There was no problem with the 1840 from Leeds to Grantham which arrived in Grantham exactly on time. On arrival at Grantham I saw that my first connection the 2003 EMT service to Nottingham was running approx 30 minutes late. I then knew that there would be little chance of getting my other connection at Nottingham for Hucknall (the 2055 EMT service to Worksop).

The train from Grantham to Nottingham actually made up a lot of time and arrived in Nottingham at approx 2055 stopping in platform 4 conveniently just behind the Worksop train. However, as I ran down the platform, the Worksop train departed leaving me with a wait of 1 hour and 10 minutes until the next one at 2205.
As there is a regular tram service from Nottingham to Hucknall, I paid the £1.50 tram fare and didn't wait in Nottingham. However, apart from the fact that I had potentially been delayed by 1 hour 10 minutes and would have been if I had been travelling to destination without a tram eg Mansfield, I objected to having to pay again for a tram when I already had a valid train ticket.

I know it all seems a bit petty for such a small amount but I thought I would sed in a claim form to EMT and see what happens. Anyone got any ideas as to whether I will be successful and how much I am likely to get?

Quite a surprise!
I didn't just get my £1.50 tram fare back but a voucher for £8. That is 10p more than my the cost of my whole journey from Leeds.
I am not going to make a habit of claiming for every delay I get but it was worth it in this case.

Everyone and anyone is entitled and deserves to claim compensation for a delayed train if it meets the guidelines set out in the train operators passenger charter, regardless of the effect it has on them,what there hobby is, what there reason for travelling is and lastly what there opinion is on the matter/offer.

None of those things really come into it.

I would still have claimed, like any other ticket holder would have been entitled to do so
My plan had allowed for minor delays, all in just one service was missed so an alternative was used
The process was made easier by having reservations for almost all essential journeys

Furthermore, although it was a leisure trip, it was paid for by my business
As such I am quite sure any other business person would have made a claim, keeping the vouchers to themself!
