Part Time Working Holiday Allowance

I have recently started a new part time job, 3 days a week.

I get 12 days leave which means 4 weeks holidays plusbank holidays

Am I entitled to extra days for bank holidays, if a bank holiday does not fall on a Monday which is one of my scheduled working days. EG Good Friday or Christmas day/Boxing day/New Years day, which sometimes will be on one of my working days, but other days they may fall on a non working day, if you see what I mean.

If a bank holiday doesn't fall on your normal working days then I don't believe you would get it for that day.

The company I work for has incorporated Bank Holidays into the annual leave entitlement thus giving 20 days + 8 Bank hols giving 28 days leave. We either book Bank hols off using a days hols or work them and keep the day for use when we want. I am in a position where I don`t work Mondays or Fridays so gain all ways

It is entirely down to what was agreed between yourself and your employer and will be spelt out in your contract or written statement of employment particulars.

Precisely. Some employers have, as others said, dispensed with the notion of a "bank holiday" and increased A/L to balance it out, which is fairer (as a part timer who worked Tuesdays and Wednesdays would never get a bank holiday, whereas one who worked Mondays would get too many).

According to this (from Citizens Advice Bureau) there is no statutory right to take bank / public holidays off work, either with or without pay

(I believe that not all public holidays are bank holidays or vice versa, but not sure I can be bothered with that now...)

So it would depend on your own employment contract.

You are however legally entitled to 5.6 weeks' paid leave a year - this is based on full time (5 day week) entitlement of 4 weeks / 20 days for annual leave and 8 days for bank holidays.

In some jobs, part-time staff specifically get a 'pro rata' allowance for bank holidays, e.g. someone who works half the full time hours would get half a day's paid holiday every time there's a bank holiday, irrespective of whether the holiday falls on a day they normally work.

Note that the CAB page says it's relevant to England, so the law may be slightly different in other bits of the UK.

There are only 6 designated bank holidays in England, (8 I believe in Northern Ireland)
Christmas day and Good Friday are listed as "Common Law Holidays" and not bank holidays.

In reality I am unsure what the difference between a Bank Holiday and Common Law Holiday is.

There is no practical difference.

No person shall be compellable to make any payment or to do any act on a bank holiday under this Act which he would not be compellable to make or do on Christmas Day or Good Friday;
