Are the 08:44 XC from york and 11:30 XC from Birmingham new street off-peak services?
It depends on the origin and destination printed on the ticket held.

If I assume you're thinking of using that service with York - Birmingham tickets then an Off-Peak return is not valid. Restrictions are:
National Fares Manual NFM 04 CD said:
Origin : YORK
Destination : BIRMINGHAM STNS
Route : 00000 - ANY PERMITTED
Standard Class Return
SVR - OFF-PEAK RETURN CC
1 Adult @£ 49.10
Restriction : 2V
Restriction applies to Outward and Return travel, Monday to Friday only. No travel restrictions on other days.
OUTWARD & RETURN JOURNEYS
By any train except those scheduled to depart before 0930.
This restriction is lifted all day from Thursday 24 December 2009 until Friday 01 January 2010 inclusive.
If I wanted to travel out on the 0844 from York, and to return on the 1130 from Birmingham on a different day within a month using flexible tickets, I would buy
York - Sheffield Standard Anytime Return £18.80
Sheffield - Birmingham Standard Off-Peak Return £34.90
Total 53.70
That saves £35.30 compared with the £89 York - Birmingham New Street Anytime Return, and I suspect that someone else may be able to come up with a combination which saves another pound or two.

If you were intending to return on the same day as outward travel my advice would be different.

1. what happened to the york-sheffield leg ? ( see OP )
2. are such off-peak returns valid in the evening peak out of Birmingham ?
