Transport Focus have replied to an FOI request with the attached information regarding correspondence relating to the change to the NRCoT which I thought might be of interest to those on here.
It's fascinating to compare it to the final copy of the conditions that was released.
It seems they agreed with some of the recommendations from Passenger Focus but not all. For example in section 9 they took out references to railcards but in section 10 they decided to keep them in, in respect of penalty fares being charged. Quite a bit was removed from section 9 it seems.
I wonder if Passenger Focus are happy overall with the changes? I've not compared every section to the final one. I've just been reading Passenger Focuses comments and then looking at the differences if I thought it interesting. It's a shame they have to send out scanned copies of the final document and can't just send out a text PDF, which would be far more useful to read and would be quicker to send even. Scanning documents takes longer than e-mailing a PDF.
To be fair, I don't know how the original request was made. Perhaps they wanted a reply in the post.
For section 13.6, did the people writing the new conditions consider it harmful for passengers to travel beyond their station when the price of the ticket to the station they actually travelled to was the same? Passenger Focus quoted an example where the ticket prices are the same and wondered what harm it was doing. However the section remains untouched.
Their comments regarding section 15.1 and 15.2 are interesting. They seemed to have not agreed with them as they didn't make any changes.
The wording is as follows:
15. Using first class accommodation
15.1 Some train services include first class accommodation. Where first class
accommodation is available, the relevant seats and area(s) of the train will be
clearly marked.
15.2 Unless Train Company staff, or notices on the train give you specific
permission, you cannot travel in first class accommodation with a standard
class Ticket. This applies even if there are no vacant seats in standard class.
Passenger focus felt that accommodation should be defined as to which areas it applies. Is it seats or is it the vestibules as well.
They also said the word of 15.2 didn't address the reality of rolling stock with first-class accommodation. They say announcements are not always given that standard class passengers can use the train. I can vouch for that being the case. Did the writers of the new conditions not see this as a problem, even though Passenger Focus did?
It's a shame we can't see there opinions of what Passenger Focus thought. Would that help people to understand the intentions of the creators of the new conditions?
