I really wish that employers would not be influenced media stories. Any inquiry into what happened should be taken objectively, on the evidence available. If LM had originally decided to have a quiet word, then unless there is significant new evidence they should leave it at that. And as it cannot be established at this stage exactly how much the guard had to drink, then I agree with Bo_Selecta that angle should not come into it.

I find the idea that something is not too bad if it doesn't reach the media, but very serious if it does, reprehensible. It's either one thing or the other.

I agree, but there is the inverse problem, where an employer might treat a serious offence more lightly to prevent news of it getting to the media. How many senior police officers, for instance, "retire early" rather than being sacked?

You have a point, but I would still prefer to see that for all levels of staff rather than a trial by media situation. Which is not to say that anyone guilty of a criminal offence should not be prosecuted and tried in a proper court!

Well, in the last year, I seem to remember Chief Constables or Deputies from South Yorkshire, West Yorkshire, North Yorkshire and Durham being eased out in this way after controversial issues. A tad coincidental - and that's only the ones from the local news.

Possibly some have but what I said was that this type of thing happens just as much in other jobs.

Health service managers, Heads of various council departments, teachers in droves etc. the public sector is legendary for it, it's not only Chief Constables who take early retirement

It's not just the police. The Vice Chancellor of Durham University has decided to retire recently, after a report alleging poor management was issued to the University.

Confidentiality agreements and early retirements are used all the time to ease people out of jobs without making a fanfare about it. Both in the private sector and in the public sector.

I completely agree about avoiding trial by media, it's not right. If the decision before was a quiet word and a diversity awareness course then they should stick to it. "Disciplinary action was taken about the matter" is all the press should know.

Posters (and possibly man) don't realise comment is racist as they are not aware of ethnic/racial aspect of gypsy heritage. - fair enough everyone knows now though.

But surely his comment wasn't directed at gypsies as a race, it was directed at the diddicoys/gypsies/travellers/whatever who go around stealing things? NOT at the decent romany gypsy people?

Fahad, you are clutching at straws it seems to me. And your choice of using 'blacks' as an example are racist in themselves. It would have been far better to use a ficticious example, say weebles or somerthing...

No, that was exactly the point. It hits close to home to emphasise the point that saying "I only meant it for the bad ones!" does not excuse what happened.

And no, it's not racist to use an example to demonstrate how something else was racist. Sounds a bit like some "No you!" logic going on here to me...

What is your point? Singling people out by race is racist, regardless of the race. No-one here said anything about white folk, but I find it interesting that your reaction is that, rather than actually addressing what he said.

Trying to make this about the poor, persecuted white folk is a) not what anyone here is trying to do, and b) completely misses the point. It doesn't matter if he'd said black, white, gypsy or jew - all would have been inappropriate.

Well, it's pointless to go round and round in circles just saying the same things over and over again, which is what is happening here now.

All some of us are trying to emphasise is that it is not a trivial matter that should be excused by saying it's just a joke. There are serious issues that are relevant to all of us at the centre of incidents like these.

But we are going round in circles because one one hand we have people that are saying it's no big deal and people who say it's outright racism. It's not up to you to say it's a 'not a trivial matter by saying it's just a joke' because that decision should be up to those that administer the appropriate punishment.
The serious issues at the centre of this incident only arise if there is collective ignorance or 'closing-the-ranks' by having an inappropriate punishment for this incident. But 455driver is basically right. This is only one person with such a viewpoint towards a minority, and as such, there is no reason for the overreaction we are seeing here because we just don't know if this is a deep-rooted issue in the rest of the company.

Well, no, because there are multiple ways something can be 'a serious matter'. Yes, it's obviously up to the bods at LM as to whether he committed a serious offence with regards to his job, but we still have the right to comment on whether it was a serious offence in society in general. Looking at things in different 'spheres' is something we all do all the time.

Also, racism does not necessarily have anything to do with intention, which is what makes it such a serious problem in society today as most people don't even realise what they're doing. We've already been over this...

I don't understand why it is not up to me to say it's not a trivial matter. All I am doing is expressing my opinion, the same as you are expressing yours.

As far as I, and apparently others, are concerned, the serious matter is not so much the actions of the guard, but the underlying issue of how we regard others.
It's not about the thoughts of one individual, or the company. It is about whether it's a good thing to perpetuate stereotypes, and how this contributes to the prejudices that fuel hatred and intolerance.

Of course, we all make judgements all the time, we wouldn't be human if we didn't and I'm sure I'm as guilty as anyone else of that. But is it really helpful or useful to make jokes against groups of people based on prejudice and (usually) negative stereotyping.

All I ask is that everyone who says 'It's just a joke', or 'It doesn't really matter' takes a minute or two to think about the real problems that lie behind what the guard said, and ask themselves whether it really is funny to joke about all Irish people being stupid, all Jews and Scots being tight fisted, everyone from Brighton being homosexual, all Muslims being terrorists, and so on.

If someone has considered all of this, and remains of the opinion that it's all fine, it's all a huge over-reaction and Chubby Brown should have had his own prime time TV show for the last thrity years, then fair enough, the debate will never convince them otherwise!

So it's not about the guard at all, he has just inadvertantly highlighted the deeper issues that are affecting our society.

Gypsies are a recognised race of people.
Therefore the remark was racist.

Intent doesn't come into it.

FWIW I don't think he was being intentionally racist, I think that- like a lot of people- he doesn't/didn't realise the full implications of what he said. The words "chav" (which is a Romany word) and "pikey" are also racist for pretty much the same reason, but many people don't realise this.

You can also argue whether gypsies should be a separate race of people- I think they should be, but not everyone agrees- but that doesn't change the fact his actions were racist.

Racism against gypsies is pretty much the last discrimination that is socially acceptable. That's a massive problem, but also why I wouldn't want to see the guard fired over the matter. People don't realise just how offensive they are being.

Ironic your remark about intent since it's your opinion he INTENDED to single out gypsies pejoratively.

There really is no issue here. One person does not make this a serious issue.

Can't you see that it is not just one person, though? The guard's attitude that it is OK to make these sort of remarks because they are 'jokes' is shared by others.

Or should we just leave things as they are, and just discipline, dismiss and prosecute people as and when necessary instead of trying to change attitudes?

Better to do something realistic. Disciplining someone is hardly dismissing an issue. It sends out a message that this sort of behaviour will not be tolerated, but those that discipline are well aware that the deeply rooted issues remain.
You are a moderator. You discipline people who post out of line, but you don't dismiss the issue that there will always be another idiot round the corner with the intention to flame. The same applies here. Disciplining the person over the remark does not dismiss the issue that in every society, there are racial/sexual/ageist issues.

Because there's more to it than discipline.

Apart from the fact that it's interesting to have these sorts of discussions, we as a society need to be more than just completely reactive to this sort of thing.

Exactly. By discussing the deeper issues it may help an individual who may not otherwise have realised, to understand the implications of something like the guard's remark. Hopefully, that individual will not then put themselves in the same position through ignorance.

Who knows, maybe if the guard in question had read a similar thread containing a similar debate at some point, he may not have come to the conclusion that warning people to beware of gypsies was a humourous or appropriate thing to say.

That said, I fully accept that not everyone will be persuaded by my argument. But at least I will have tried!
