Er, it is.

(2) In these Regulations—

(a)any reference to a “valid travel ticket” is a reference to a travel ticket in a person’s possession which is valid for—

(i)the day and time of the journey that person is making, has made or intends to make;

(ii)the train and route used for that journey;

(iii)the age of that person;

(iv)use with any rail card in the possession of that person which they are entitled to use for that journey;

(v)use in combination with any other travel ticket in the possession of that person which they are entitled to use for that journey; and

(vi)the class of travel used by that person; and

(b)any reference to a person leaving a train includes a person present in or leaving—

(i)a station, having left a train arriving at that station; or

(ii)a compulsory ticket area, having left a train arriving at that compulsory ticket area.

(3) Where the terms on which a travel ticket is issued require the holder to produce on request any other document(11)when using that ticket for travel, any reference in these Regulations to a travel ticket includes such a document.
Which as you've quoted, requires reference to the terms on which a travel ticket is issued.

I think any further discussion of this point probably needs to take place in the split-off thread.

Good day everybody,

I am back for further advice.
It is soon to be two months since the incident (7 Oct) and I am yet to receive something in the post.

I have the RM redirection in place, and I also had someone check the previous mailbox until the moment redirection became active.
Furthermore, in my last communication with IRCAS I had received the following reply:

"Your new address has now been passed on to the Prosecution department.
You should receive something from them shortly." (dated 2 Nov).


My email to Greater Anglia directly was returned with the following:

"Thank you for contacting Greater Anglia Customer Relations regarding your penalty fare.
In order to update your address, please contact GA Prosecutions directly at prosecutions@greateranglia.co.uk
I would like to advise you that any appeals in relation to penalty fares are to be directed to the Independent Revenue Collection and Support (IRCAS) who will then investigate this for you. I have provided the contact details below: omitted" (dated 8 Nov).


Given the IRCAS response, and redirection in place, I hadn't contact prosecutions directly, so I have just been waiting, but I feel it has been too long to receive something now.

Would you reach out again, or just continue sitting like a duck?

There is nothing to do for now. You simply need to wait until they write to you and see what they say. It seems pretty likely that they will make an allegation of an offence, even though as previously said, I don't see that you committed one given the circumstances you described.

Whilst it is common to get back a letter within a couple of weeks, or a month or two, they do have 6 months from the date of the alleged offence to start a prosecution (which can, in theory, be done without any prior correspondence with you).

In practice, we almost never hear of prosecutions being started without prior correspondence, and so the practical limit of them writing to you is probably something like 5 to 5.5 months from the incident.

You may therefore wish to extend your Royal Mail redirection, if you still haven't received any correspondence from them by the time it's due to expire. I'd say getting 6 months' redirection is a wise move whenever you move home, even if you don't have a potential prosecution on the cards.

If possible I'd get someone to check the mailbox every now and again as well - the Royal Mail redirect is v good but not always 100% watertight so if you can get a check that is no bad thing (and if post there, then complain to Royal Mail - that happened to me once I had a redirect and it did not work as advertised and Royal Mail refunded some of the fee I had paid).

Otherwise, yes, sit like a duck I'm afraid.
