Thank you to everyone for your advice. My understanding is the Trainline ticket with the student railcard is cheaper than the Oyster tap in, but i can see the optics do not look good. She will try and contact Southeastern to see if they received the letter and if she can resolve this out of court, and I will seek legal advice as well.

Are you aware of the legal firms that get mentioned on here occasionally as specialising in rail fare evasion cases? They claim to have ability to contact the rail firms through existing established channels. Manak solicitors is one also Penman Sedgwick (I have no connection). I think there was another one mentioned positively recently but I can’t recall the name unfortunately.

But still seems possible se trains may have not examined the paperwork sent in before or lost it perhaps.

Another one mentioned recently is Makwana’s which had a positive result with TfL, which is notoriously difficult to avoid prosecution with as it doesn’t offer settlements.

You can get a railcard discount added to your Oyster.

I think you should read the witness statement again and ask yourself if it really was a mistake.

Although the discount wouldn't be applied to peak fares. However, if the journey is Grove Park to Charing Cross it would appear that undiscounted Oyster fares will be cheaper than an Anytime Day Return (also undiscounted as below minimum fare)

Hi all, just to let you know, she instructed Manak solicitors to act on her behalf. Spoke to the paralegal at 2.30pm, by 11am the following day she heard the court case had been dropped and an out of court settlement had been reached (~£160). The main points southeastern want to know is if you accept liability and are remorseful, any mitigating circumstances, the likelihood of reoffending and if you are willing to settle out of court. Thank you for your constructive advice and solicitor recommendations.

That 's good to hear and thank you for the update. Manak does appear to be quite effective at getting a resolution. Maybe southeastern judges that the cost of the advice is enough of a penalty. Speaking of which, would you mind telling us what its fee was, so that we can inform others of the likely cost in future?

Yes it was £600 - an expensive life lesson for my daughter. I wonder whether it was because it got to court summons stage and if she chose to seek legal advice earlier it may have been cheaper. Anyhow, once they got the main facts, they seemed very sure they could get this settled out of court and I was surprised how quickly it was done.
