Letter Not Arrived from Northern

Hi all,

An update - I sent off emails with evidence etc on Monday and Tuesday, but with no response decided to call them up this morning.

I was told that I have to pay the full £111.20, I cannot appeal the extra £100 charge, and I only could have disputed the £11.20 charge as incorrect within 14 days of the first letter. Which of course, I could not see so couldn't do this.

I will have to pay it but doubt I will receive any of it back.
I will send the money and then another email to the DRPU department afterward explaining that I have paid only to stop the matter getting worse, but expect them to investigate the incorrect charge and hopefully rectify the situation by refunding me.

Do I have any legal standing here or do I just have to suffer the loss because of their mistake?

In your situation, I would send them the amount of excess they should have charged you, with a clear explanation of why they're trying to charge you the wrong amount.

In other words, the price of a ticket that would have allowed that break of journey, minus the price of the ticket you did have. That, presumably would regularise the situation?

There is no appeals process. This is a negotiation hoping to reach an out of court settlement so don't get hung up on Northern saying you must do X by Y.

If you know the correct email address to send it to then I would get that sent off asap. You have 14 days from the 2nd July, so a few days yet.

I sent emails off with evidence explaining and requesting the FPN be withdrawn due to my circumstances on Monday and Tuesday, however with no response by now I decided to call them up this morning.

I was told I have to pay the full £111.20 charge, as the only time I could have appealed the initial £11.20 charge was within 14 days of the first letter, which of course I could not do. And I cannot appeal the £100 FPN.

I have decided to pay the fine to prevent this getting worse, and will email DRPU unit explaining I am only paying to prevent more payments being requested, and that I hope they will investigate this incorrect charge and refund me. The lady on the phone said they will be uninterested in looking into it for me however.

Do I have any legal standing here or will I have to suffer the loss due to their negligence?

Thanks for all advice given here, I honestly thought it could be resolved but it seems unlikely.

Update no2: Good news!!

I rang up the DPRU instead, and spoke to the prosecutions team. I explained that I was on holiday when the letter first arrived and she happily took off the £100 extra charge for me and I ended up just paying the £11.20.

Didn't want to push the excess even though this was the correct procedure, as I just wanted it over with more than an extra £3!
