Hello I have just received this exact same letter but I already replied with this ‘
Thank you for your letter and email.

I am writing to request full details of the specific journeys and tickets you are referring to, as I am confused and currently unable to identify the matters in question.

Once I have this information, I will be able to review my records and provide a full and appropriate response, including any relevant explanation or supporting documentation.’ Have I messed up??

Perhaps not completely messed up, because you’ve not admitted anything, but keeping schtum might’ve been a better option

Hello I got a response:
Thank you for contacting us regarding your case.
Your account was highlighted due to some tickets either being purchased on board the trains or on arrival at stations. These tickets have been scanned on the barriers just after purchase to exit the barriers. These tickets are not valid. Tickets must be purchased prior to boarding the train to be valid. This flagged your account as possible fraudulent travel.
Upon further investigation, we have come across irregularities with your ticketing purchase history. This is where the tickets may not be reflecting your full journey.
Some examples:
[they put a table of my journeys]

The ticket historic data reflects that your journeys are normally Chelmsford and Stratford. There is no scan data at Shenfield and Ingatestone, and we have checked with our systems, which verifies that all barriers were in operation and fully manned on the dates you were travelling. Therefore, could you please inform us on your full journeys on Greater Anglia services?
In addition to this, we do not seem to hold any records of your railcard for the below periods:
Could you please send over evidence of your railcard. This could either be from your railcard account or purchase email confirmation clearly showing validity periods.
At this stage we would like to offer you an opportunity to explain these irregularities on your account, and based on your response the decision will be to either offer you the opportunity to repay any funds relating to these journeys (plus our administration fee), (b) to forward your case to our prosecutions department for processing or (c) close your case (if sufficient evidence has been provided and proved).’

Help any advice is greatly appreciated

Have you ever been stopped in person or engaged.in any other correspondence you've not mentioned?

If the answer to the above is "no" then say nothing and enjoy a few months more of threats as the most likely outcome.

No I haven’t. I’m worried though since they’ve put in all these dates etc. have you seen this happen to people before at this second reply stage?

They know from the computer records etc. that someone used the tickets on the dates and times highlighted and the account used to purchase the tickets. They don't know who used the tickets sufficient to satisfy a case for prosecution unless either they catch the individual in the act or someone owns up to it.

It is however plausible that they have a civil case under balance of probabilities. They would have to formally notify you if they are taking such action. There isn't much practical experience of this recorded on this forum.

If you’ve NOT been stopped in person and that’s ALL you’ve said to them in response, then ignore, ignore, ignore. Do not say another word to them.

stop your fare dodging.
This is the key piece of advice. TfL are known to look out for offenders to catch them in the act, which then makes prosecution easy. We have never or rarely seen the mainline railway companies do this, but the fact that TfL do it shows that it can be done. You probably don't want to be the test case if Greater Anglia start to use the approach so all your travel now needs to be done properly.

Greater Anglia also do this, but only for very large-scale fraud.

Advice remains the same, so long as facts haven't changed.

This is a very standard follow up. Ignore.
