Late-night Virgin train passengers 'can't get off' at Nuneaton

An enquiry not specifically about this particular service, but...
If a train is 'set-down only' for station X and station Y, and I want to travel between X and Y, is there actually anything that can prevent me making that journey? Can a penalty fare be issued, in the unlikely event of an RPI being on board said service ? ;)

VT don't issue penalty fares, but you would be liable to pay for a single from the last pick-up station before you boarded.

A Penalty Fare can be issued if a number of conditions are satisfied - one of the necessary conditions is that the passenger does not hold a valid ticket for the journey taken. Consequently, a passenger holding a valid ticket from X to Y at that time cannot be issued with a Penalty Fare.
Please be specific with X and Y and explain how they relate to Nuneaton if it is not a qustion about tickets to Nuneaton.

The 22:00 King's Cross to Newcastle is set-down only at Northallerton, Darlington and Durham - but you often see people boarding at Durham. The train is advertised as a departure to Newcastle on the platform CIS - and as everyone knows that the reason for it being set-down only is is merely to allow to the train to run ahead of schedule,[*] it never seems to be an issue.

I can't imagine even the most jobsworthy RPI would ever consider trying to charge for a single from York...

[*]And it means that EC don't need to provide alternative transport from those stations if there's engineering work, etc.

I was responding in particular to the suggestion that the driver held a key for Nuneaton station and could go and unlock the exit. As for the guard leaving the train, I meant the platform as well. Probably not prudent.
