Irishman Oisin Tymon - who spent six months off work on full pay - stunned BBC chiefs by turning down the offer, even though new host Evans personally gave it the go-ahead.

Instead, the 36-year-old launched a lawsuit against 55-year-old presenter for racial harassment and personal injury, and is seeking at least £100,000 damages from Clarkson and the Beeb.

His decision to sue has left BBC chiefs stunned - and presents a huge headache for Clarkson, who is desperate to settle the case.

A source close to the case revealed: “BBC executives feel a little disappointed that it has come to this - they have always been very supportive of Oisin and sympathetic to him....

Hmmm so originally he said that all he wanted to do was put the whole thing behind him and get back to work, now he has refused to go back and is sueing both Clarkson and the Beeb. Think he is after the money somehow. According to that Mirror article, Clarkson tried to settle quietly out of court but the Beeb refused. There is far far more to this than is out in the open.

I suspect that Clarkson was at the end of his rope. A quick six figure sum from Clarkson may well have swept the whole thing under the carpet, but it was Clarkson who reported the matter himself. He just wants to get on with his new life, things are dramatically different to how they were for him two years ago, between Argentina, Slopegate, and the divorce, he presumably wants to put the past behind him as much as anyone in the public eye can.

The BBC however have different priorities, not least not wanting to encourage money grabbing from its presenters.

If the producer was really damaged by the incident why not press charges? Why not pursue the civil case 6 months ago. Why wait for the world to get over it before bringing it back up. He won't be the first person to have suffered this type of verbal abuse at work, and Clarkson wasn't the only "bad apple" in the production team - his slope comment wouldn't have made it to air (even if it was Clarkson who came up with it) without passing through producers, editors and the exec producer.

A very valid point, no 'star/celebrity' is the be all and end all of what appears on our TV screens, the problem with that though, is that those who dislike the character Clarkson portrays on screen wouldn't have such a barn door to aim at with their comments

Frankly, this stinks. The punch was wrong, no argument with that, but it's past history now, it was dealt with. The time for any criminal, civil, or employment legal actions was back when it happened and certainly no later than approx. 30 days after the BBC internal inquiry concluded.

Tymon may have been a victim back in March, but he quite clearly did not wish to pursue legal remedies at the time or while the original matter was still being dealt with. He's now had a 6 month paid holiday according to reports, and is giving the appearance of doing nothing more than abusing the system to try to make a quick money grab as he pushes himself out of the job he claimed to love, evidently having exhausted the BBC's patience for paying him to sit at home quietly doing nothing for them.

I quite understand Clarkson being willing to just throw £100k at it to make it go away once and for all. That's relatively small change for him, and fairly good value for drawing a final line under it. I don't think Tymon is actually due £100k from Clarkson at all, and that he has little to no case, but the flawed legal system that we have sometimes makes a settlement the correct choice even when there's no real case. I also quite understand the BBC legal team telling Tymon to sod off, rather than opening the door to blatant opportunistic cash grabs. To me, this is only marginally above pure blackmail or extortion.

The Mirror report comes solely from an 'unnamed source' who is close to BBC executives.
It looks to me like someone is trying to put pressure on via the press.

It is also possible that the BBC tried to impose new conditions on his employment, based on the press interest in him.
That would reasonably explain why nothing has happened until now, without having to paint anyone as a villain.

One has to remember that Clarkson was the reason that the show Tymon was involved with was the big success it was. If the Mirror is correct then it would seem that Clarkson has tried to settle with Tymon quietly but the Beeb have scuppered that. What I don't get is why he didn't settle with Clarkson privately and then go after the Beeb separately. Wants more money?

Or why didn't Tymon go to the police immediately instead of waiting and getting this story more public traction and therefore, one would have to assume it to be the bottom line, more money.

Of course precious few facts have been reported, but there's been plenty of spin from the BBC (i.e. Tymon's being greedy and it is all Clarkson's fault). Call me cynical, but I can't help but wonder who's behind the spin.

I would also (once again) point out the time limits for bringing a claim to the Employment Tribunal. For discrimination cases the time limit is three months from the last incident. Clearly the BBC or Clarksonhave done something to Tymon that makes his lawyers believe the clock has restarted.

Not to mention the cost of bringing a claim, which is currently £1200 for discrimination cases.

For him to be able to bring a claim something must have changed in the very recent past.

Pure speculation, but I'd guess refusing to return to work after extended paid leave, and therefore being terminated, would probably enable a tribunal. We don't have sufficient detail in the reporting to properly reach that conclusion with good certainty, but that's roughly the "smell" I'm getting from it.

We don't know when he brought the claim. It may have been 3 over months ago - these things do tend to drag on, particularly if there are attempts to settle out of court.

Shoddy reporting again. Looking at the story, Clarkson is not being sued. The producer has taken the BBC to an employment tribunal.

Perhaps he was persuaded not to?

Anyway, the tribunal, if the case ever gets that far, should reveal the circumstances and timeline of this unedifying episode.

Oisin Tymon launched the action against the presenter and the BBC after a "fracas" last March that left Mr Tymon with a bloody lip.

"I would like to say sorry, once again, to Oisin Tymon for the incident and its regrettable aftermath," Clarkson said.

"I want to reiterate that none of this was in any way his fault.

"I would also like to make it clear that the abuse he has suffered since the incident is unwarranted and I am sorry too that he has had to go through that.

"I am pleased that this matter is now resolved. Oisin was always a creatively exciting part of Top Gear and I wish him every success with his future projects."

Mr Tymon's lawyers said the case had been settled but did not give details of the settlement.

It is understood to be in excess of £100,000, an amount to which both Clarkson and the BBC contributed.

Some people need to get a grip

So many people do not understand that Top Gear was just a rip off of Alan Partridge, and Jeremy Clarkson's public persona is an act.

It's actually quite a clear satire on the kind of people who like Top Gear.

At an employment tribunal you would usually sue your employer for allowing a situation to happen, but in some circumstances you can also jointly sue the individual responsible for the situation. You'd normally only add an individual where you know they have sufficient funds to pay any judgment or, in extreme cases, if you're wishing to destroy them financially.

In this case Tymon sued his employer and the multi-millionaire Jeremy Clarkson. Both will have had to contribute to the settlement but, of course, we don't know in which ratio.

I enjoy watching Top Gear now and again because I find it funny. I'm aware it'd an act. They film and stage it well, especially the buts where they go travelling.

I think Eddie Jordan will be good on the reboot and he's a character and probably doesn't need to act to be that.
