Published yesterday by BBC news:

Top Gear producer to sue Clarkson

The Irish Top Gear producer punched by Jeremy Clarkson is suing the presenter and the BBC for racial discrimination.

Lawyers for Clarkson and the BBC attended a closed-door hearing with Oisin Tymon's legal team at a London employment tribunal on Friday.
The case centres on "verbal abuse" that accompanied a physical attack during which Clarkson struck Tymon in March.
Clarkson, who was dropped by the BBC following an internal inquiry, will front a new show on Amazon Prime.
The inquiry, headed up by Ken MacQuarrie, found Mr Tymon was subject to an "unprovoked physical and verbal attack".
Lawyers Slater & Gordon confirmed on Friday that they had been engaged by the producer.
A statement by the BBC said: "We will be responding to this claim, but will not be commenting further at this time."

If you remember the original thread where the incident was first discussed on this website, it was laughable to see that some of the forum members who made posting contributions tried to make light of the matter and were far more concerned with what the "celebrity" status of Clarkson meant to the broadcasting company.

Given half the chance, you would have expected them to put forward Clarkson for "sainthood"..<(

I do hope it is something a little more serious than calling him a "thick paddy" or "bog dweller" or the like.

Others may take issue with the above remarks, however to me they were once common parlance and formed the butt of "Have you heard the joke about the Englishman, Scotsman, Irish and Welshman"

Each joke was a parody of each nations supposed national characteristics (for younger members) :idea:

It was in the news at the time. Clarkson called Tymon a "lazy Irish c**t" and punched him in the face. Is that serious enough for you? :roll:

The most offensive part of that is probably the expletive at the end. However if they have worked together for a number of years the entire exchange would amount to no more than a bit of ribbing between colleagues. (at least from my experience). The punch however is a little OTT.

Well he has disappeared from your screens unless you are an Amazon prime member. For the rest of us we can watch a decent show on Amazon while the rest of you are stuck with the dribble Chris Evans produces <D

I don't think anyone is questioning what was said; the issue here seems to be timing. If Tymon ostensibly felt offensive at the remarks, he should've gone to the police. This smacks to me of lawyers lining their pockets and another PR stunt..

I'm not sure how that can be seen as racist. It's offensive, but I don't think its racist.

People have been prosecuted for that (seemingly more common in Scotland than in England).

As detailed in the previous link, racial groups can include national origin amongst other things - so people can't just substitute Jewish, African, Chinese, Polish, Irish in to their favourite insult and claim it isn't covered by racism laws.

So when will things like census forms and surveys be changed to take account of this absurdly white definition of what is meant by "race" and give up the good old "white Caucasian" formulation? And when will all official documents allow us to describe ourselves as English rather than British if we so desire? And come to that, how should people from Northern Ireland desribe themselves?

Racism? The Irish are a nationality not a race. If he's going to be sued it should be for common assault. The white Irish are from the same western European stock as the white English. Like the English they have a smattering of Danish, Norwegian, Saxons et all but they and we are all the same race.
This racism business is getting out of hand.

I think we did the 'it's not really racist if they are white...' thing last time.

As pointed out already, the law disagrees, and has done so for many years; as the topic of this thread is a legal case that seems like a relevant definition.

Census forms never ask for race, as the only answer is "human".

They ask for "ethnic origin" to which the answer is "prefer not to say"

Clarkson did not hit Tynon because he was Irish, he hit him because Clarkson is a ****.

By all means sue him for common assault, even for loss of earnings as new top gear tanks as Amazon have poached the best people from the old program (and I guess didn't take Tymon, hence not having sued this long), but throwing in "racism" will simply lose support from a lot of areas.

Like others have said millions of people watch the content he produces on TV or on the DVD's he creates so clearly millions of people disagree with you. The petition to get the Beeb to reverse its decision get huge amounts of signatures in a matter of days. I'm sure I would think that some of the stuff you like watching is "utter drivel"!

But to say he was so offended by the "racist" nature of Clarksons verbal abuse . Come on this producer made his money working with Clarkson and would know what an oaf he is and how verbal tirades like that are perfectly part and parcel of his character. I suspect this was not the first time he had been at the sharp end of one of Clarkson's rants .

This had all gone quiet and suddenly now the amazon adverts have started this comes out of the woodwork , me suspects someone has been whispering numbers in this producers ear .

We don't know what is in the tribunal papers, but it's unlikely to simply be "racism", although I'm sure the BBC (who were his employer and will also be involved) would like everyone to think Tymon is just a money grabber.

It's clear he was hounded out of his job and its only right that he's compensated for that. And where there is racially motivated (or not) bullying you can name the perpetrator- and make him personally liable- as well as the employer.
