I think that sums things up quite nicely.The issue as I see it is that legally speaking fare evasion occurs when you don't pay the correct fare for the journey taken. As DaveNewcastle points out above if you pay for a ticket from station A to station B having made a different journey then you haven't paid the correct fare for the journey taken, even if the amount that would have been due is the same.
I agree that it would be ridiculous to be taken to court in this particular case, however the TOC would have a valid case.
