Interviewed under Caution - Ticket Purchased After Departure

This evening I travelled from Bournville to Chester Road. I got on the train and sat down, admittedly without a ticket. When I heard Revenue Protection Officers making their way down the carriage, I purchased a ticket on the Trainline app.

Minutes later, when the officer approached me, I provided the barcode, which he scanned and stated was not valid for travel. I stated that it was valid for the journey he was making, but he stated that as it was purchased after travel, it was not valid (I now know this is the case).

He asked me for my address, which I gave, and then my name. I stupidly answered with a comic name because I was frustrated. He asked me to produce something to confirm my name, which I refused to. I know stupid. He then told me it was an interview under caution and showed a badge. I then produced my driving licence to give my correct details.

The interview then continued where he asked questions, though frustratingly recorded responses as single words before I'd finished a sentence. At the end, he asked me to sign his phone. I asked why, and he attempted to record that I had refused to sign.

I confirmed I wasn't refusing, but asking for clarity on what I was signing. He said it was to confirm the interview was accurate. I said that it didn't say that anywhere, and he again said I was refusing to sign. I again just asked for some evidence of what I was agreeing to, and he said he would not hold up the train for me and got off. I continued my journey to my destination.

Questions are:
1. What next?
2. How can I settle this without a criminal record?

  1. Presumably you have a receipt with a reference number on it. They will write to you in due course, but it will likely be a number of months.
  2. You grovel a bit, apologise, explain you now understand that boarding a train without a valid ticket is a criminal offence and you’ll ensure you don’t do it again, ask to pay fares due plus their investigation costs in lieu of prosecution.
Don’t worry too much about the comic name etc. They’re used to it.

They will examine your Trainline purchase history also.

They provided a paper 'ticket' for the rest of my journey but nothing about the specific issue.

You’ll need to wait for them to contact you, this will be weeks or months, possibly as long as 6 months. Don’t contact them until they contact you, it’s not in your interests. Come back here for help when they do.

It’s very likely you’ll be able to settle out of court - expect to have to pay the full Anytime fares for this journey and anything else suspicious they find in your booking history (unless you can explain it convincingly), plus around £150 for their admin costs.

For context, the Anytime fare from Bournville to Chester Road is only £4.50, but if you’ve done this on other routes it can get extremely expensive, for example the Anytime fare from Bournville to Euston is £98.50.

Technically this isn't the problem. At least, not currently anyway.

The problem is that it's usually against the law to board a train without a ticket. Unfortunately as you did this and have essentially admitted to it, you have a problem here. I wouldn't worry about it too much though. It's unlikely to be anything other than an expensive mistake.

It is now.

Sadly the OP probably talked themselves out of a Penalty Fare and talked themselves into a write up for prosecution.

WMT will probably settle, but it’ll be for quite a bit more than a Penalty Fare would have cost.
