I am writing to you regarding your letter on Friday 7th March in relation to an incident in Birmingham Moor Street on the 7th November 2024 . I would firstly like to apologise for what I have done and that I have learnt from my mistake and I vow to not do this again. As I understand this is a serious matter, I hope my explanation is going to be satisfactory enough to not be deemed an offence against railway byelaws and the Regulation of railways act 1989.



On the 7th November, I was intending to pay for 2 tickets for me and my partner from small heath to Birmingham moor street. In a rush, I thought I had done this until we got to Birmingham moor street and realised the payment hadn’t gone through. We then both proceeded to buy individual tickets for the journey at Birmingham moor street which was then flagged by one of your colleagues resulting in this.



I wish for this matter to not be settled at court and I would be willing to pay any fine that you deem acceptable. Hope to hear from you soon.

You give your location as Stratford, and one assumes this is the address the company has for you on file.

What is the likelihood they believe you boarded at Small Heath, the very last station before Moor Street? (well, except on match days for BCFC)

They've intimated they think you have committed other offences too. Is that true? Have you short fared in the past? The company seems to think so, because they mention other offences in their letter.

They don't believe this, which is why they have intimated the fare has been evaded on other dates. If that's true you might want to gather some evidence to that effect; it looks to them like you've clearly been buying the cheapest ticket to get through the barrier once you realise it's closed.

OK. I suggest you look at posts by longstanding member Hadders who regularly suggests points to make, and check you have covered hem.

As to your draft reply:
1. You committed an offence,, full stop - either boarding or travelling without a valid ticket (it doesn't matter at this stage), so the last sentence in para 1 is irrelevant.

2. Para 2 sets out your wishes - you are not in a position to dictate, so ask them if they would consider a settlement, including the fare and admin expenses.

It is a generic letter, but they will have researched your travel history - will they have found evidence of cheating? Don't incriminate yourself here or to them - but be prepared!

It's not your choice on how the matter is dealt with. Chiltern are entitled to send the case to the Magistrates Court if they want to.

You might want to say something like:

I wondered if it would be possible to deal with this case without being prosecuted. I am prepared to pay the outstanding fares plus you administrative costs in dealing with this matter.
