Hi all
I need advice regarding my issue
Me and my wife started journey from Farringdon station to Cambridge station without tickets.the reason was my mobile phone fell down and it stopped to working.all my banking application in that phone.we do not have any physical bank card. We need to reach home urgently because she have to take medication bcz she had surgery and has kidney pain. In this scenario we started our journey. In train when ticket inspector came he asked me about ticket. I told him that due to my phone I was unable to buy. I came under intense pressure. I totally puzzled at that time. He asked me about the station where I started my journey. Due to his rude behaviour I was shivering I told him I started my journey from hitchen. At that time my wife was in washroom room when he came out of the washroom ticket checker asked the ticket my wife pointed out me because she is unable to speak English.then ticket checker asked me why you did not tell me about your wife. Then I told him I started my journey from Farringdon station . Then he gave me notice of intention to prosecution to me and my wife
I gave him correct details about the address but he put wrong details on that receipts.
Please advice me what I should do because from that day I was unable to sleep and eat.my health getting down because my heartbeat continuously high
Thanks in advance

First of all relax and try and stop worrying. This type of issue is quite common and nearly always can be resolved with the Train Operating Company without going to court.

Does the Train Company have your correct address or not? If not (and I think that is what you are saying) then you must write to them and give them your correct address. This needs doing straight away.

Please can you upload to this thread any documents the ticket inspector obscuring any personal details and reference numbers?

Forum members can then give advice as what to do next. Usually this means waiting until the train operating company have written to you which of course requires them having your correct address.

Problems tend to arise when train operating companies do not receive replies to letters they send.

You were puzzled that you were getting a hard time for travelling without a ticket? And because of that you decided to claim that you were making a shorter journey than you actually were?

One of things we strongly recommend in your dealings with the railway when the contact to you is to be apologetic and understand that what you did was wrong. I'd suggest that you need to adopt a different tone in your dealings than you are here - it's not the railway's fault that you chose to rely purely on a phone and not carry any other form of payment - that's fully on you.

Nevertheless, once you are contacted you should be able to get an out of court settlement and avoid prosecution, and this forum will be able to help you do that. GTR is usually very good at not prosecuting cases like yours, but I'm afraid you can expect it to cost the full single fare (each) plus GTR's costs, which are likely to be around £150 (not sure if that will be doubled for dealing with your wife too?).

I’m a bit confused. You’ve uploaded both a Penalty Fare notice, and a notice that you are being referred for prosecution. Usually it’s one or the other, not both.

And they were not all issued by the same officer. This is rather confusing.

It rather begs the question that if the penalty fares were paid whether that bars any action under the MG11 (Witness Statement - Ref for Prosecution).

I think the OP has to do the following:
(1) Try and pay the penalty fare on line to establish if the penalty fare is "live" or has been withdrawn. If the penalty fare is withdrawn then this can be ignored. If the penalty fare is live then I think he should pay it so that at the very least it wont escalate. Theoretically the OP can not be sanctioned both by PF and by MG11 for the same offence.
(2) Await the arrival of the letter(s) for both the MG11 and then reply along the lines previously suggested. He could of course state that the MG11 issued to him is rendered void by the payment of the Penalty Fare if he has indeed been able to do this.
(3) I would suggest posting both the letter (once received) and the draft reply so that they can be checked by forum members before the reply is sent.

I'm guessing the PF was issued at first and then when it was established the OP was lying about where they started their journey, the officer decided a prosecution report was appropriate instead.

I agree this is likely what has happened.

I’m not certain how the OP got through the barriers at Farringdon though.

How did you pay for that? It’s important you get the sequence of events right in case you are asked during the course of the investigation.

Where was this? Where did you start your journey? And why didn’t you get a ticket to your final destination?

Dear I have only£30 in cash at that time that’s why I was unable to buy
Can you also answer the first two parts of @AlterEgo’s question. Saying you bought two tickets from “a guy” is very vague, and we need more detail to be able to help you.

I’m not sure that’s procedurally correct or fair. Otherwise on a journey with say 11 intermediate stations you could get 12 mg11s or penalty fares.

I start my journey from Heathrow airport
Ok - you should keep your tickets just in case they ask where you came from, because they may want to know how you accessed the train in the first place without a ticket.

Presumably you wouldn't be daft enough to lie about where you got on and where you are going that many times.

In principle yes, if you were inspected after every stop. But since RPIs don't tend to grip the same people over and over on the same train, I think we can file this under unlikely enough never to happen.
