Incorrect discount sold // Refund methods

Good afternoon all.

Long story short, my partner is entitled to a 50% discount when travelling on SDR's, for her and a companion travelling with her.

Again, cutting out a lot of faff here, the ticket seller didn't know about the discount so ended up issuing a 34% - (railcard) - discount, instead of the 50% that she was entitled to.

The TOC concerned have admitted that this was their error and that we were correct, and have issued an Rail Travel Voucher for the difference between what we should have paid and what we were charged.

My question is this: do I have any entitlement to insist that the refund is issued in cash? (/cheque, bank payment, etc).

My reasoning is that this is not an error on behalf of the passenger. The ticket clerk, through poor training, was unaware of the discount and sold the wrong ticket. The passenger, whilst knowingly being sold the wrong ticket, had no choice but to over-pay in order to travel.

I'm not jumping up and down and making a fuss here - I will use the RTV. I was just wondering whether, as this was the TOC's error, whether the passenger has the right to request a refund through the original method of payment.

If I went to Sainsbury's and bought a £1 bottle of coke, and was charged £3, then complained at customer services, I wouldn't accept a refund in the form of £2 worth of nectar points!

I'm sure you would be within your rights to insist the refund was in the same form as the payment used for the original ticket.

Agreed. RTV's are normally sent out as a matter of course, but if you ask for a refund to take the same form as the original payment method, I am sure they will do it.

From the TOC's point of view this is probaly just the easiest and quickest way of dealing with it.

You could ask for it to be refunded by cheque if you want to put up with the palaver.

Thank you all. As mentioned initially, I will make use of the RTV - I was just interested in looking at the situation hypothetically and in whether you could insist in a method of payment refund.
