Hidden rules and split shifts?

Hello Everyone,

I have a quick question regarding the hidden report and rules regarding the 12 maximum working time for non-safety critical FGW staff.

If for example someone was to work a 0600-1000 shift in the morning, would they they be able to work a 1300-1700 shift in the afternoon, also possibly repeat the next day?

The reason that I ask is that I have received differing answers when I have previously asked - varying reasons have been:

• That a shift is defined as one continual working block and the above would be considered a breach as there is no 12 break between the two above shifts, being as they are separate ones.
• The above is fine, as both shifts in their entirety do not overlap 12 hours and thus the same pattern could also be repeated the next day as it would allow for a 12 hour break between.

Which is right or wrong - if any?

That would be fine as it is start and finishing time that matters, look on the split as a long dinner break.

I have never heard of split shifts within any roles for safety critical personnel on the railway. I have had jobs with a 3 or 4 hour break in the middle but get paid for the break. As for non SC staff I wouldn't know but there are many non SC staff that do not fall into hidden.

With Virgin it does.
I guess it would be different for each TOC.

Just a quick follow up folks.

The request to work split shifts was declined on the grounds that there was an unpaid break in between and this is not allowed at First Great Western..

I've asked for the official rules on this, as it seems that there still seems to be differing opinion based on whom you ask. Who would be the best person or office to contact regarding this? The union, FGW head office, etc?

I'm not looking to cause a problem, but would just like to know what the official stance is from a documented source - the RMT's website does contain a section in Working Time Regulations, but does not cover this specific scenario.

Each TOC will have its own requirements and agreements. The only people you can ask for clarification will be FGW.

Not anyone on here unless they directly work in the HR dept of FGW.

I don't think we have split shifts but that would just be an exceptionally long and boring PNB.

As long as you finish no less than 12 hours before your next shift you are fine. I guess working 4 hours then starting another shift 3 hours later would be fine as it is only a short 4 hours anyway.

Also remember you cannot work anymore than 13 days consecutive.
