Help!! What does this mean and what do I do

Hi, I’m looking for some advice about a railway ticketing issue and what I should do next.


I was stopped by a member of railway staff and they took a witness statement from me and gave me a slip. The situation was quite messy, and the staff member was very rude and accused me of not having a railcard, even though I did have one and provided it. My ticket also worked at the barriers!


My mum had dropped me at the station, and once I was on the train, she bought my ticket for me. I provided both my ticket and railcard when I was stopped. I genuinely wasn’t trying to avoid paying for the journey, but I’m worried because I don’t know what the witness statement means or whether I’m going to be prosecuted.


I’d really appreciate advice on what I can do now, whether I can appeal/explain the circumstances, and who I should contact.

The issue appears to be the ticket being purchased after departure, which is not a valid ticket and may constitute a criminal offence. Please tell us as many details as possible, including your age, where you got on the train, and what was said to you by the inspector and on what grounds they claimed the ticket was not valid.

Oh and Gatwick Express don't go to Southampton. It was likely a Southern service using a train wearing the GX livery, because Southern and Gatwick Express are linked and often share rolling stock.

You say that the ticket worked the barriers, but if your mother only bought your ticket after you boarded the train, how did you get through the barriers at the station where you boarded the train?

There are various different types of railcard, are you sure that your mother entered the correct type of railcard when she purchased your ticket? If you hold a different type of railcard to the type your mother entered, then the ticket won't be valid. Also, are you sure that you hold the right type of railcard for your age? If not, then both the railcard and ticket won't be valid.

It is unlikely that you can do anything now, other than wait for them to contact you. What does the slip that you were given say to do? It would help if you could post a copy of that slip, with any personal details redacted.

there are similar circumstances on this thread where some else bought a ticket with railcard discount and transferred it to the person travelling, the name on the ticket did not match the name on the railcard so a tir was issued.

i dont think we know the result yet

Yes good point, or mum bought ticket on line and e-mailed it etc to the OP but this all happened after the OP had boarded the train so the inspector's device could detect that the passenger boarded without a ticket.

@ciaram1537 - some general advice that may help you with the context - if you tell us more you will get specific help - things likely to be different if you are under 16 or under 18 years of age


Firstly, you committed a criminal offence by travelling with an invalid ticket (IF ticket was indeed invalid) and railway companies are entitled to prosecute you in the Magistrates Court if they want to. The good news is they will normally offer an out of court settlement to people who co-operate with them and who haven't come to their attention before.

Next, what happens is the railway company will write to you. The letter will go to the address that you gave them / on any of your ID they checked so you need to be able to access hard copy post at that address as they often send things that way (but also check e-mail and spam). It is extremely important that you reply, and you'll only have a limited time to do so (often 14 days from the date on their communication).

When you receive the letter post a redacted copy of it in this thread, along with your draft reply and forum members will proof read it for you. You'll find lots of example letters you can use in this section of the forum but the reply basically needs to mention:

- That you are sorry for what has happened
- What you have learned from the incident and will not do this again
- That you are keen to settle the matter without the need for court action
- Offer to pay the outstanding fare and the railway company’s administrative costs in dealing with the matter

The railway will probably offer you an out of court settlement. Expect to have to pay the cost of the fare for the journey you made at the full Anytime rate with no credit given for the invalid ticket you purchased. In addition they will charge an admin fee, typically £150. They will also audit your online ticket purchase history and if this shows you've purchased other tickets that were not valid (eg railcard discounted tickets when you did not have a valid railcard, or tickets for only part of the journey, or tickets bought after boarding the train you travelled on ) they will probably factor the cost of these journeys into the settlement offer. Depending on how many journeys you've made over the period concerned this could end up being expensive.

Settlements usually have to be paid in full within a few days of them being offered so if money is tight you might want to think about how you will raise the sum required at short notice.

The only thing I would add, if you have not already done so, is keep all records of the ticket purchased and emails receipt and if mum has an account for ticket purchase do not delete it

update on this, the appeal on this thread has been sucesssful so this should clear up any railcard issue, just leaving the question was the ticket purchased after boarding
