GTR Prosecution letter received - advice needed please!

Hi all,

I have received a Notice of Intention to Prosecute letter from GTR after being caught short faring at City Thameslink by revenue protection. When questioned by the officer where I had travelled from I said Teddington and that I forgot to tap on so I then bought a ticket on the train from Blackfriars to City Thameslink. They took my details on their system and the officer mentioned I was not under arrest but anything I said could be given in evidence. I was fully compliant and respectful. I had only moved to Teddington at the start of January and started a new job and thought by short faring I would save money as it was costing about £250 a month otherwise, which in hindsight was a very poor decision and I have learned the hard way by receiving this letter. I have some other short fares on my trainline account from the month of January before this incident occurred but never before this, and I'm not sure if this will be checked or not or if I should mention it - it probably adds up to about £200/£300.

I don't know what to reply in my letter as I was untruthful in saying I forgot to tap on at Teddington as there is no barrier there - although I short fared. Do I still say I forgot to tap on at Teddington and stress I will pay any outstanding balance quickly, or that I short fared? I would appreciate any assistance in drafting my response. I definitely do not want to bring this to court, this is the first time where this has happened to me and I really would like to emphasise how regretful and apologetic I am and more than willing to pay any amount owed plus any admin costs and ensure it will never happen again. I am paranoid this will affect my employment if I was to be brought to court and prosecuted.

  • The stations* where you actually started & finished your journey - Started at Teddington and finished at City Thameslink
  • The stations* where you changed trains (if applicable) - I changed trains at Wimbledon and boarded the train to City Thameslink
  • If you presented a ticket(s), the information* stated under "Ticket type", "From", "To", "Route", and any other relevant details - I presented my ticket on the trainline app from London Blackfriars to City Thameslink when asked by the revenue protection officer
  • Details of any Railcard(s) held - I have a 26-30 railcard but I did not apply this to the ticket I bought
  • When and where ticket(s) were purchased, including whether this was prior to the journey commencing - I bought the ticket while on the trainline app while I was on the train
  • What happened in any encounter with railway staff - I tried to tap out and it didn't work. I got asked where I travelled from and said Teddington and that I forgot to tap on so I bought the ticket from London Blackfriars to City Thameslink, which I deeply regret as this was not truthful. The officer took my details and said the company would reach out in due course. I was fully compliant with the officer and gave all my details to them and apologised and said it would not happen again, and they acknowledged this and said it's ok. The officer also asked if I was willing to pay the fare difference and I said yes, but I didn't actually have to pay anything there and then. They were friendly in the end and I again acknoweldged how apologetic I was. They said to to reply to the letter with the same as what I told them.
  • We need to know what outcome(s) you would consider satisfactory - This was poor judgment on my part shorting the fare which I deeply regret and am ashamed of doing. I have definitely learnt my lesson and purchased a monthly season ticket for £224 after this happened to ensure I am covered for my journey, and have been using contactless every time I've been going into the office since my monthly season ticket expired. I am very anxious about their intention to bring this to court and would much rather settle this quickyly while emphasising that I am sorry and have learned my lesson from this.
Any advice would be much appreciated and thanks very much for taking the time to advise.

There's no need to mention previous journeys in your letter. GTR will check of their own accord if they want, and they have the ability to do so, but may well not bother to. That said, don't explicitely say you haven't short fared before.

In my opinion you should now tell them the truth about the full incident and say that you made an error of judgement by not purchasing a ticket and then lying in a moment of panic. It's important you tell the truth and are cooperative.

A case like this is highly unlikely to reach court, especially being GTR, but it is important that you cooperate with their correspondence.

When did you buy the Blackfriars to City Thameslink ticket? Just before the inspector arrived? Was your ticket checked on the train or at City Thameslink at the gateline?

Things to mention in your reply:
  • That you're very sorry for this error of judgement, will never do it again, and will always purchase a correct ticket in future.
  • You could say that you have purchased a season ticket, and give the ticket reference number. (This isn't essential but would help your argument.)
  • That you're keen to resolve the matter without court action and are happy to pay the outstanding fare and any costs GTR have incurred (they will charge an admin fee in their settlemtent offer, likely about £50-£150.)

Provided you reply and are appologetic, you should be able to secure an out of court settlement.
Have a read through some other GTR Notice of Intention to Prosecute threads on here - there are loads of them - to get further ideas of what to include in your letter.
Make sure to put your case reference number in your letter reply.
Post the draft repsonse on here for forum members to proof read.

I bought the ticket on the train not long after I got on. It was checked at the gateline exiting at City Thameslink. Please find my draft below. The letter does say "We give you the opportunity to tell us what happened from your point of view", so I just wanted to confirm does my response include what has happened from my point of view, or is it more of just an apology/taking responsibility? I am writing in response to your letter regarding the incident at City Thameslink.

I would like to sincerely apologise for my actions on this occasion. I accept that I did not hold a valid ticket for my full journey from Teddington to City Thameslink. I also regret that when questioned by the officer, I gave an explanation that was not accurate. This was an error of judgment for which I take full responsibility for and am very sorry about.

I fully understand that my actions were wrong, I am disappointed in myself and deeply upset by the situation. I can assure you that this is not something I will ever repeat, and I will ensure that I always purchase the correct ticket for my journey in advance going forward.

Following this incident, I took immediate steps to rectify my behaviour by purchasing a monthly season ticket for my commute for 1 month and when this expired I have since been travelling with valid tickets at all times.

I would be very grateful if you would consider allowing me to resolve this matter without court proceedings. I am more than willing to quickly pay the full outstanding fare for this journey, along with any administrative costs incurred.

This has been a significant lesson for me, and I sincerely apologise again for my actions and any inconvenience caused.

There is also a portal where you can submit your response which is stated on the last page of the letter - by using my reference number and authorisation code at the top of the letter. Maybe this is easier than having to post a letter to them?

If that's what it says, then a message by the portal will be fine. But before relying on this, check the wording very carefully: until recently GTR have refused to accept responses by email, and the portal has only been for sending in proof of forgotten Railcards. If they have relaxed this to accept responses then that's really good news - but don't get caught out by being ahead of them!

Totally agree. Personally I’d always post stuff too. It’s not that expensive to use tracked 48 Royal Mail. Or even just risk basic second class post.

It looks ok. No point sending it until Tuesday due to bank holiday tho so you can await any further views here until then if you wish.

Could be a week or two. Some seem to take much longer eg months.
Have a look at other cases and you may be able to plot a timeline.

It’s possible that you will hear by letter again.

Good news

Keep proof of payment when you pay it - and keep all the correspondence - keep it long terms (ie over a year at least) in the unlikely event you ever need it.

hey Im in a similar situation however I cant find the link to the portal is there any way you can share it with me. I've tried the link on the letter but can't find anything.

It might be best to start your own thread where you can upload whatever letters you have been sent by the railway company so we can advise you what best to do.

If your letter does not have a portal link detailed within it (the ones we have seen on here have been on the 3rd page) than it may be that you can not reply via the GTR portal and you should reply hard copy to the address given on their letter - but without even seeing your letter we can't see if that is good advice or not - it might actually be bad advice!

I will say though that if you are replying to the railway company about this in the post you should send it tracked postage from a post office (eg Tracked 48 service) and keep a copy of every page toy send them.

There is an example of a letter in post #16 of this thread


But unless you have received an exact same letter with the same portal info in it then I would be using hard copy post to send your response.

As I say, start a thread here and people will advise appropriately (see also the pinned post at the top of the forum about what info to provide)

Sounds like a good result all things considered James, can I ask as facing something similar, did you acknowledge the other short-fares or just reply to the incident they questioned you about?

Welcome to the forum,

You may well have started your own thread already which I have not yet found, in which case it is best to discuss your matters on there. If not, then it would be good to start one. It's easiest to keep one case to a thread as they are all different.

I think we're dealing with SWR here, unless I've missread. I think they have two different letter templates they send to people. Either, they mention one incident, or they say they are investigating irregularities in your ticket purchase history. In the former case, only address the specific incident. In the latter case, you will need to acknowledge other instances. If you need more help with this then I and others will be happy to do this on your thread.
