GTR - expired railcard

Good afternoon,

I was travelling from Victoria to Brighton with an off-peak return ticket on May 8 purchased with a 26-30 railcard. When my ticket was checked they asked for my railcard, which I said I had left at home, being on my way to a wedding which I had left for in a hurry, and was quite out of sorts.
The revenue protection gentleman explained I could submit it via platform portal when I got home, and then began to take my details. He flagged that I was 32, to which I replied I'd renewed it with a 2-3 year extension. I carried on my journey and bought a return journey at full fare, as advised.
On returning home, I realise I have gotten the paper 16-25 and digital 26-30 mixed up, the latter of which was only extended digitally until mid-2024. I don't even have the app on my phone, as it's a bit of a broken brick. Immediately on discovery, I called GTR to ask to pay a fine for not holding a valid railcard (to which I was told to wait), and then carried on to buy a network railcard at Victoria station as soon as possible, to ensure I am properly covered for future journeys.

I've made several short trips previously on the 26-30 railcard, but have never been asked for it, so have never had occasion to pull it out and inspect properly. In the last year, have been diagnosed and am now undergoing trial medication for adhd - I admit my organisation is awful. All of this is absolutely no excuse, and I can't believe how negligent I've been, but I hope to put it right. To make it worse, being flustered, I provided my partner’s surname in error rather than my own, though all other details were correct.

I know general advice is to wait for a letter, but is there any way to at the very least call/write in to correct details, including that I did not hold a valid card, and offer retroactive recompense?

Welcome - hope the below is of help

Were you given any paperwork at the time - especially anything with a reference number on it?

some initial advice on your points:

On your last point - do not call them to try to ask to 'pay a fine' for this (by which I suspect you mean pay the sum you see on posters at stations which are about Penalty Fares - you have not been issued with a Penalty Fare of course, and they can not be issued at a later date about an incident) - you will have to wait for them to contact you about this - which could take some weeks or even months I'm afraid.

Providing your partners surname - and wanting to correct that. It's probably not a big deal so long as you gave them the correct postal address they can still contact you and you can correct it later. However, correcting that by e-mal is one thing you could do now if you wish - not to customer services e-mail but we can give an e-mail address from other threads you could use for that. Please say if that would help
It would need to be a really simple message:
eg
Stating time and date and place when stopped and any ref number, and just clarifying the name you gave and the correct surname you should have given

If you want to do that I recommend posting the text of what you want to say here for checking before sending it.

Buying a Network Card: - that was a good move - it's something you can tell them in due course you have done to take action to prevent the issue happening again - But - do check the Network Card rules / T&Cs - they are different than the 15-25 & 26-30 Railcards with different rules for use and discounts - make sure you select the correct railcard option for the Network Card when buying tickets and that you know when you can and cant' use it

In general
here is some advice that is often given on the forum which might be helpful to you to know what to expect in due course and how to respond to it

meanwhile ask any questions that occur to you.

General Advice

Firstly, you committed a criminal offence by travelling with an invalid ticket and railway companies are entitled to prosecute you in the Magistrates Court if they want to. The good news is they will normally offer an out of court settlement to people who co-operate with them and who haven't come to their attention before.

Next, what happens is the railway company will write to you. The letter will go to the address that you gave them / on any of your ID they checked so you need to be able to access hard copy post at that address as they often send things that way (but also check e-mail and spam). It is extremely important that you reply, and you'll only have a limited time to do so (often 14 days from the date on their communication).

When you receive the letter post a redacted copy of it in this thread, along with your draft reply and forum members will proof read it for you. You'll find lots of example letters you can use in this section of the forum but the reply basically needs to mention:

- That you are sorry for what has happened
- What you have learned from the incident and will not do this again
- That you are keen to settle the matter without the need for court action
- Offer to pay the outstanding fare and the railway company’s administrative costs in dealing with the matter

The railway will probably offer you an out of court settlement. Expect to have to pay the cost of the fare for the journey you made at the full Anytime rate with no credit given for the invalid ticket you purchased. In addition they will charge an admin fee, typically £150. They will also audit your online ticket purchase history and if this shows you've purchased other tickets that were not valid (eg railcard discounted tickets when you did not have a valid railcard, or tickets for only part of the journey, or tickets bought after boarding the train you travelled on ) they will probably factor the cost of these journeys into the settlement offer. Depending on how many journeys you've made over the period concerned this could end up being expensive.

Settlements usually have to be paid in full within a few days of them being offered so if money is tight you might want to think about how you will raise the sum required at short notice.

I suppose what it comes down to is, if GTR post a letter with the address you gave, will it reach you? If you're picking it up from a communal mailbox or something, then I'm sure that's fine. But if the address would not be sufficient to reach you, then that would be a problem.

ref your address: as others have said it just needs to be an address you can be confident to receive post at. I'd use whatever you use for any official communication eg what is on your drivers license or electoral registration record or with bank etc

That's pretty much the standard auto e-mail people report on here that they get sent after e-mailing GTR. I think they have accepted change of details sent that way in the past (ie your name), but they don't want people using it to try and sort out their case - which is why I suggested not calling them about that etc

But if you want to be sure they will correct your details, in the next few days sometime, print off your e-mail that you sent them, sign it by hand, make sure it has your postal address on it - pop it in an envelope to that address at Kings Cross station - a second class stamp on it should be fine.
If you want to be confident that it gets delivered correctly you could pay more and use Tracked 48 postage from a post office - then you can keep the proof of delivery should you feel you want to have that.

So long as you have access to a printer no harm in doing that.

I know it might be ignored but am hoping that is easier for them, and that it might stop any delays relating to “snail mail”!

I’m still within the 14 days submission window given to upload a railcard - could I confirm that I didn’t hold a valid railcard for my journey with apologies? Is it worth uploading my email confirmation of my 26-30 railcard and extension (and even a scan of my 16-25)?

Did the Inspector sell you the ticket, or did they give you a zero fare coupon or some sort of receipt (basically evidence in case you are inspected again later on same trip, because they are already going to raise a fine or charge). Or did you just decide to buy a ticket on an app whilst on same journey after inspection.

Or did you mean you bought a single ticket when making the return journey.

What actually happened is important, along with any letter they write to you, because it will affect best way it needs to be responded to.

The revenue protection officer gave me the print-off/witness statement, which allowed me to travel the rest of the way. He said the return portion of my ticket wouldn’t be valid for the way back and that I would need to buy a new ticket from Brighton to Victoria, and that I could apply for a refund for the ticket I didn’t use.

I bought the Brighton-Victoria online using Trainline (just through the site, not the app).

OK - thanks for your patience.

We have seen it advocated on here that if a person has been asked to upload a copy of a Railcard but then realise they do not have a valid Railcard to do so - that it may be worth uploading a letter instead - I can't recall if that has worked or not but on the basis that it can't do much harm it does seem no bad idea. Incidentally - the reason for the railcard upload facility is to allow them to process cases under the so called 'forgotten railcard policy' which allows one incident per year of forgetting to carry / being unable to show a valid railcard to be 'let off' without sanction)

However - your draft is quite a good one, if you had got to the stage of receiving a 'Notice of Intention to prosecute' (NIP) type of letter along the lines that GTR usually send out and which you can see numerous examples of on other threads - but you are not at that stage yet, and we know (as confirmed by the auto reply to your e-mail - that they don't accepts mitigation by e-mail etc - so I think you need a slightly different message to upload than this one your draft.

Also- and just to check as your original post #1 isn't 100% clear to me - but it sounds like (due to your confusion) you have not actually had a valid railcard since 2024 - and maybe never had a 26-30 Railcard (let alone one you tried to extend to cover your current age)?

But -- and this is really important - you thought you had Railcard all this time, but due to carelessness had not actually checked it was valid - ie you did not set out to deliberately evade paying the correct fare, you've just messed up your 'personal admin' which came to light after being inspected?
If that is all true (and it's vital that you do not say anything to them that is a lie, or might look like a lie to them because that is probably a really good way to diminish your chances of settling this - better to say nothing than lie to them)

So based on my assumptions above, if you wish to upload something in the 14 day window I would suggest something more like this (based on your draft) - I hope the amends are clear
You must check that is is
- all correct and true
- you are happy with it, and if not amend as you wish
- I think it might be helpful for the surname issue to be mentioned again so have inserted that - do remove it if you think not necessary

However - your draft is quite a good one, if you had got to the stage of receiving a 'Notice of Intention to prosecute' (NIP) type of letter along the lines that GTR usually send out and which you can see numerous examples of on other threads - but you are not at that stage yet, and we know (as confirmed by the auto reply to your e-mail - that they don't accepts mitigation by e-mail etc - so I think you need a slightly different message to upload than this one your draft.

Also- and just to check as your original post #1 isn't 100% clear to me - but it sounds like (due to your confusion) you have not actually had a valid railcard since 2024 - and maybe never had a 26-30 Railcard (let alone one you tried to extend to cover your current age)?

But -- and this is really important - you thought you had Railcard all this time, but due to carelessness had not actually checked it was valid - ie you did not set out to deliberately evade paying the correct fare, you've just messed up your 'personal admin' which came to light after being inspected?
If that is all true (and it's vital that you do not say anything to them that is a lie, or might look like a lie to them because that is probably a really good way to diminish your chances of settling this - better to say nothing than lie to them)

So based on my assumptions above, if you wish to upload something in the 14 day window I would suggest something more like this (based on your draft) - I hope the amends are clear

To explain, I have held a 16-25 railcard, a 26-30 railcard, and 1-year extension of that (expiry mid-2024). The first was a paper copy in a small blue folded card-holder, the second a digital one with Railcard app, and the last one that looks like I got it as an offer online from Trip.com.

The inspector saw my ticket was on a 26-30 railcard, which he questioned when I gave my birth date (I'm 32), and I said it was the 2-3 year extension version. I was confused when the ticket instructor told me after our interaction I could check the expiry date on my phone, because I had the physical one in its blue cardholder at home, and my phone didn't have a railcard app.

I came home to send a picture of it in, I opened it up and saw it was actually the 16-25 railcard. I know now 26-30 is only digital and extendable by one year, so I couldn't have had a paper version! In my mind, it made sense that I would've gone to a ticket office and got a paper renewal because my phone's so often on low battery/out of memory/glitching, but I was wrong. I've never checked because I rarely travel out of London (a handful of short trips), and I've never needed to open it up, and with the past few years having a lot going on, I'm ashamed to say it's not been something I've even thought about, assuming I'd sorted it.

Writing it out, I know how incredibly stupid and idiotic this is - I've been hugely careless and irresponsible. I didn't intend to dodge the fare, but I want to take accountability - I'm glad I was stopped so I can sort this now, and would be more than happy to pay on past journeys too if needed.

Thanks - that's all clear to me now, your explanation about your Railcard(s), their expiry and what you did / thought you had done ref the Railcard, now makes sense to me and I understand your position.

I think all you can do for now is consider my amended version of your draft and make sure you upload it (after you have finalised it with any of your own changes) before the 14 days you were given originally (ie when asked to show the valid railcard which of course you can't do) - either by typing and printing a copy, or if your access to a printer is not achievable within the timeframe - (which might be 21 May not 22nd depending on if the 8th May counts), then a neatly hand written version instead.

That might be why inspector realised you couldn't have had an age related physical railcard and asked to see it on your phone to chevk expiry

It's because you can't be 32 and have a 26-30 railcard. They are only issued digitally and for a year.

We have seen it advocated on here that if a person has been asked to upload a copy of a Railcard but then realise they do not have a valid Railcard to do so - that it may be worth uploading a letter instead - I can't recall if that has worked or not but on the basis that it can't do much harm it does seem no bad idea.
