Not sure if that would stand up, also depends on the TOCs local instructions for dispatch.
It could easily be argued that it wasn't safe to to look out, what with the likelihood of the yobs assaulting the Guard as he went past. According to the RMT he was spat at but it missed. Most TOCs don't encourage Guards to lean out of the window due to the risks involved, I don't know TPE's policy though. Plus, if you were going by the letter of the law/rule book, why didn't the driver look out the window and put the brake in, as the rule book puts equal responsibility on both grades? Some drivers at my TOC always look back, most never look back though. I'd say most Guards at my TOC look out, but some never do. No one is required to though. That rule is a bit of a grey area.
Edit: At the end of the day though he did look out, was aware of the situation and theoretically made the wrong decision in that split moment, even though it was seemingly a decision made in good faith. The problem is whether the punishment fits the 'crime', which I personally don't think it did.
