Freedom Pass application after TFL seized it

Hello,

My partner had my Freedom Pass seized by TFL. Can I apply for reissue of Freedom Pass as 'Lost'? Will issuer know that it was seized and it was misused? Should I mention in the application that it was misused with my knowledge of it?

Context: No TFL letter came yet. Partner will pledge guilty and that it was used with my consent

If your partner says you consented to it being misused, then you are also in trouble, and are telling them you willingly don't respect the rules of the freedom pass.

Assume the existing pass has been deactivated, and a note added against holders name with whatever they told the Inspector. (It might not, but don't want to dig a bigger hole for your family).

It's normally better to stick to "no comment" (unless/until you've taken legal advice) - attempting to explain who knew what may inadvertently dig a deeper hole!

You haven't told us the circumstances in which it was seized, but if the person it was taken from was accused of committing a criminal offence and says you knew, then that provides evidence that might be used to charge you with a criminal offence too!

Fortunately, TfL seems to have a policy of not prosecuting people over a certain age, but was your partner using it because they are too young to qualify for their own?

If they believe it was borrowed with your consent, they can use that as a reason not to give you a replacement.

I don't think that's an option here. When reapplying for a Freedom Pass to be reissued one has to give a reason.

As far as I know there's nothing stopping you from reapplying for a Freedom Pass but if it was me I would wait until the case against your partner has concluded before applying.
