Hello,

I am getting a FOSS 3 in 7 rover for the week starting tomorrow (17/7/16), and had a few questions that seems to be poorly answered elsewhere across the internet, social media, and ticket offices.

Is the ticket valid on London Midland and/or Southern Rail services (if any SN services are running anyway haha)?

Thanks. :D

I imagine the non-mention of London Midland and Southern is an oversight. I would argue that if the ticket, once purchased, doesn't display a TOC restriction, then no such restriction applies or is enforceable, as per the Conditions of Carriage (10).

Some other sources claim this however:

Monday to Friday: Valid from 09:00, plus the following additional trains:

07:22 Axminster - Salisbury (train continues to London Waterloo)

08:00 Axminster - Salisbury (train continues to London Waterloo)

08:27 Swindon to Exeter St Davids (train continues to Penzance)

08:36 Taunton to Bristol Parkway

08:39 Patchway to Paignton

08:49 Hereford to Worcester Foregate Street (train continues to Birmingham New Street)

08:53 Weymouth to Gloucester

08:54 Swindon to Cheltenham Spa

08:50 Great Malvern to Westbury

The 0849 is a London Midland service. Is it valid only on this specific service?

It also says that only Arriva Trains Wales, Great Western Railway, South West Trains and CrossCountry are participating TOCs.

As an aside, does anyone know if any Rovers have been issued in the new format?

Down here in Cornwall only TVMs are issuing new format tickets. All of the TVMs have a sign saying they don't issue 5 types of tickets, Rovers being one of them, so none in new style from Cornwall

Where there are conflicting terms and conditions, the one most favourable to the customer should prevail.

I have used a Freedom of Severn & Solent on both London Midland and Southern services a handful of times. Never had any issues.

I can't see this ever being an issue.

Agreed on all counts. The 'participating operators' list on the national rail website is best ignored - I think it's just supposed to indicate the operators which operate in the area/map of validity, and it is frequency wrong.

Tickets can only be restricted by operator if such a restriction or prohibition is clearly marked on the ticket itself (see NRCoC condition 10). There are no such restrictions marked on an FOSS Rover (see attached).

For the sake of clarity, the FOSS Rover is valid on all rail services after 0900 (all day on Sat, Sun and public holidays), including those operated by London Midland and GTR, along the routes mapped. Suggestions to the contrary are wrong.

Based on my extensive experience using the FOSS rover on numerous occasions on Southern branded services between Portsmouth and Southampton, and London Midland services between Great Malvern and Worcester there should be no issues whatsoever.

While I'm happy that the OP won't have any trouble, does the fact that some Rovers have 'AS ADVERTISED' in the validity field have any bearing on this point?

None whatsoever in my opinion. The condition clearly requires an operator restriction / prohibition to be marked on the ticket itself. Simply saying 'as advertised' or any other similar text does not satisfy this requirement.

It's moot anyway, given the FOSS does not have an "as advertised" marking on it, and even if it did it is advertised as providing "unlimited use of all National Rail services on the map in the validity section."

For the avoidance of doubt FOSS rovers are not, repeat not, valid on ScotRail trains. It does not stand for Freedom of South Scotland. :p
