For Contactless PAYG, when will inspector be correct to issue a penalty fare?

Coming from the "Greater Anglia Penalty Fare - Contactless Mistake at Kelvedon" thread, as requested, a new one.
I'm sorry but this wouldn't work. The terms and conditions of using contactless PAYG on National Rail state that you must touch in and out at each end of the journey. Furthermore, the maximum fare deducted at Leytonstone would not cover a journey beyond the standard zones, so an inspector would be correct to issue a penalty fare.

If for some reason you would like to debate this further, please start a new thread so as not to further complicate this one.
As per title, when is it correct for revenue inspector to issue a penalty fare, for a passenger with a touched in with a contactless card?
In the original thread, passenger having touched in at Leytonstone, to travel down the GEML: contactless is valid to Witham, so inspecting before there, all that they can do is a 'revenue inspecting touch' (and let the contactless end of day processing do its stuff). The passenger will only be 'in breach' (and so liable for a penalty fare) until they have not touched out, having - one trusts - had an indicated (see discussion re High Wycombe here) opportunity to do so.
