On Sunday, I travelled from Liverpool to Plymouth.

The 1234 train was cancelled and the 1334 arrived in New Street very late. As such, I'd missed my booked Cross Country train down to the South Coast.

There were no seats at all on the 1612, so it was upgrade (for £15), or sit on the floor by the toilet....for 4 hours....

London Midland WILL be refunding my ticket, but do you think I have grounds to claim the £15 back as well?

You did choose to upgrade to receive a better travelling environment, and they provided you with that- in this case a seat in a quiet part of the train with a table etc...

London Midland will give you a 100% refund on the ticket anyway for being delayed for more than an hour so effectively it's cost you £15 1st Class Liverpool-Plymouth.

Don't count on it, but you could always ask to see what they say

I have had similar experiences in the past. As daft as it sounds your ticket is only a voucher for travel.,regardless of if you sit on a seat or stand in the bogs.

I very much doubt a refund will be given, but let us know how you get on though.
