Fined for not producing a railcard

I was issued a penalty fare for being unable to produce a valid railcard for a train ticket that had a railcard discount applied. At the time of inspection, I had just returned to the country after two weeks abroad and had my belongings packed tightly in a large suitcase. My railcard was inside the suitcase, and I explained to the inspector that it would be difficult to retrieve it immediately without unpacking and reorganising the entire contents.

The inspector advised that I could appeal the fine if I was later able to present a valid railcard. Upon getting home, I discovered that my previous railcard had expired just 9 days prior. I renewed it immediately on the same day I received the penalty fare.

Given the circumstances, I would like to appeal the fine and respectfully ask if some leniency can be considered, especially as the renewal was done promptly and I had no intention of travelling without a valid railcard.

Intention is not required, as its a strict liability offence, much like speeding. The promptness of renewal won't really matter for much either.
Unfortunately, unless there was a technical reason why the PF shouldn't stand, I dont see any method of appeal that would be successful. You are responsible for renewing your railcard.

Either way, please post a copy of the notice, suitably reacted for the experts to look at

You have my sympathy but
Unfortunately your plan ref an appeal won’t work in my view.

The law on such appeals is that you have to show that the penalty fare was incorrecty issued in that situation. It’s not an ability to appeal based on it being unfair that you got a penalty fare in the scenario.

By all means submit an appeal but I would not expect it to succeed.
