It's more complex and they really don't care for it. TfL is a giant prosecutions factory which prosecutes tens of thousands of people every year. It's you and a few hundred other people every day caught in the swishing net of the inspectors, no point drawing out the process for them and expending resources. Not having to prove intent makes the prosecution very simple indeed.

You’re overthinking this. They won’t be prosecuting you for fraud as it’s very difficult to build up a prosecution case and obtain a successful fraud conviction. As stated above, you’re just one of many cases for prosecution, and the method that TfL is the easiest, quickest and cheapest way for them to successfully obtain a prosecution.

TfL will not prosecute you for fraud. They are prosecuting you under the TfL Byelaws and they're not going to change that. Fraud is often memtioned as a possibility in letters from train companies and TfL but in all the years I've been on this forum I've never seen a prosecution under the Fraud Act for railway ticketing matters. This is a simple, straightforward case, TfL deal with thousands of them every year and they get prosecuted under the TfL Byelaws.

If a case is sent to court then there are only possible outcomes:

Not Guilty - the court decides that you didn't do what you were alledged to have done (or there was insufficient evidence to prove you had done it beyond all reasonable doubt)

Guilty - this happens if you plead guilty (i.e. you agree you did what you were accused of) or you are found guilty by the court after a trial. If you are guilty you are convicted and the court imposes a punishment which is a fine for this sort of offence. You also have to pay a surcharge, compensation for the fares avoided and TfL's court costs. A record of the conviction is made (this is the criminal record).
