Expert Witnesses

I have a routeing and connection time dispute with a TOC, which is part of a court case.

They themselves will sell the itinerary, and I know that it is a valid route in the routeing guide.

They dispute this nonetheless, and so it might be helpful to have an expert witness.

I note a thread from 2016 about this, but I hope there might be some updates in 2025?

What type of court case? Initiated by you or the TOC? What stage has it reached? Roughly how much money is at stake?

Initiated by me via Money Claims.

TOC refused to pay out when they caused me to be delayed >2 hours; TOC took over 3 months to acknowledge case; TOC now argues ticket wasn't/isn't valid on route taken. TOC also argues that minimum connection time is irrelevant (when they breached this due to delay).

Ticket was 3 figures, so not trivial.

Usually TOCs are reasonable and settle at money claims mediation, but this TOC refused even a tokenistic settlement and so is progressing to county court.

Delay repay claims can be very complicated as there are a lot of undefined situations that rely on custom and practice rather than explicit contractual terms.
So it may be necessary for people to go through all the details and consider where your situation sits on the scale and even whether any disclosures might be necessary.
