EMT disruption this weekend: overtime ban?

There is a more recent emphasis from ASLEF to have Sunday in in the working week, a 4 day, 32 hour week with no overtime. The annual conferences IMHO have the vocal people that are in love with the idea and you can't argue with the majority there. I respect their opinions and understand the idealogical way of thinking but it gets an X-Factor style 'NO' from me.

The TOC drivers that have Sunday inside as far as I know are..

SWT... One of the first TOCs to have Sunday inside was done shortly after privatisation I think?
TPE... As part of a harmonisation package for EX ATN and EX FNW staff, seemed quite a poor deal on the surface of it
Crossrail.... Massive jump in pay compared to Anglia to tempt them in
Northern Rail East.. No idea when this happened. Probably slipped it in when no one noticed.
LOROL... I think they may have a choice to opt in or opt out?

So really not that many after 18 years of private companies.

TOCs don't really want it, it costs them a lot of money. They want to run a 7 day railway on 6 day rostering as it's cheaper and can try and scrape enough volunteers together last minute each week by ringing them up and offering them pots of gold and new cars.

Many staff, local reps and even some company council reps don't want it as they want Sunday off rather than a Tuesday when your kids are at school... despite the extra cash on the table. Conditions and not pay are the way forward when you are in the 40% tax bracket.

I don't want to see trains get cancelled, no one gloats or wins over this. I've been a victim a few times of no Sunday trains due to lack of staff. The only real short-medium term solution is offering more money on a Sunday to tempt people into work.

TPE traincrew sunday is not classed part of the working week, although rostered, you can opt out of a rostered sunday, but you are still required to work it if there is no cover. Sundays either side of a leave week are automatically not rostered unless specifically made available. Being guaranteed overtime there are usually plenty of takers, york and manchester depots due to their size are far easier to cover tho than say newcastle or liverpool as these being smaller and end of the line depots there isnt necessarily a train service available to transport cross cover traincrew into position to cover the shift.

Taxi!!!

Think drivers sold it as a perk and are normal rostered tho...

If Sundays are not part of the working week, if you couldn't get cover and didn't go to work what exactly could the company do?

Overtime is not compulsory so cannot legally be enforced no matter what is written on your contract!

Implied terms and conditions or something like that, when I was doing rosters on staff side it was said by signing off the roster with Sundays on them then you agreed to the depot working them unless they went not available within local agreements. Obviously different TOCs and grades may have different agreements but that is how it was worded to us.
