The company also backs off if you don’t reply.
Oh yes certainly if they have no evidence, there's nothing to pursue. I was mainly referring to when an innocent person is mixed up and sent a threatening email and does reply. Though, we have yet to see an innocent person get one of these data analysis fishing emails (unless there has been one that I've not read).

it's certainly an effective strategy!
It's definitely that, because we've seen on the forum a number of people changing their buying habits because of the email, even if they have chosen not to respond. Even that is a win for WMR.

Just a gentle reminder that this thread is to discuss @gis1 soecific case. Related discussion about the tactics and general behaviour of WMT should be in a separate thread.

Re: Escalation of case.

As we have not heard from you, we are now reporting you to our Prosecutions team, this will now incur further costs and fees.

They will contact you in the coming weeks, we advise you respond to them as to ignore this could lead to legal action.

Your case will no longer be with us from 2nd of May 2025, and we will forward all evidence to our Prosecutions team.

West Midlands Trains take travel fraud seriously and are committed to prosecuting all cases of fare evasion to the full extent of the law. Travelling on the railway with the intent to avoid paying the full fare is an offence under the Regulation of Railways Act 1889, as such, a single offence carries a maximum fine of £1,000 and/or three months’ imprisonment and, a criminal record.

Consideration will be taken as to whether this matter amounts to a much more serious offence under the Fraud Act 2006, in particular ‘Fraud by false representation’.

Regards

They will probably email again but you shouldn't concern yourself with their increasingly desperate tone. They do this all the time, feel free to browse the forum for examples of these cases.
I did not reply and they have sent this:

Can I ask if there’s been any further emails/action on their part? I’m currently in a very similar situation and unsure of what to do.

The OP has not been back for several months, and we would ask that you start a new thread if you want advice. Please read the pinned thread at the top of the Disputes Board for details of the information we need for members here to be able to provide the best assistance.
