EWS and ASLEf should ask to see the original from the photographer then they can examine the RAW image not a zoomed cropped copy of a jpeg which has then been compressed further to go on a webpage.

In 1999, a Virgin Trains driver was photographed allegedly reading a newspaper while in charge of a high-speed train on a Newcastle to Plymouth cross-country service.
Which had the red tail lights photoshopped out and headlights photoshopped in...

The arm on the left is clearly not the drivers, either that or he has a seriously deformed limb.

Some people really need to get a life.

Having seen the original, I don't think this one has been photoshopped, but that is for EWS to decide, not us.

I don't want to assume any truths here, but if it is true, I would be both shocked and amazed. That is inappropriate behaviour, but as I've said I don't want to state whether or not it is true; I'll leave that to the experts.

Until I see the original photo, I am not passing comment but I do agree with the point about the arm.

The originals have been taken down from the website where they were first hosted. the photographer is quite annoyed that the media used them, and that someone (a rail pics fan??) reported them to the media.

On other fora, 66 drivers have said the pic looks real if you were sat with a foot on the window ledge and the other on the DSD.

Having seen the original, The picture does not look to me to have been photoshopped, and would anyone really put that much effort in just to get a driver into trouble?

I'm not condoning the drivers actions, although I think we should wait and see what happens before jumping to any conclusions. But perhaps someone should take a photo of a car driver on their phone while driving and send it to a newspaper and see if it gets the same coverage...

I agree, just as dangerous...plus, as we know, trains have safety devices in which to automatically stop the train if neccessary...unlike cars.

Plus, they're making a deal of the foot on the dahs - ever time you see a shed go through Donny, they always have they're feet up on the dash.

I know I shouldn't be on about spelling, but the title of the thread made me think that he actually was paying some sort of tax or penalty. There are some cases where spelling mistakes are acceptable (when you can't confuse the word with anything else), but it's not the case here.

I thought they got rid of second men?

I see a lot of freight trains that are regularly double manned these days. DRS usually have two in the cab, although I dont see EWS with double manned trains all that often.

He is sat on the left side of the engine (right of the head-on photograph) if that helps.

In the Driving Position then.

A number of questions can be asked but this photo can't help answer them.

1) What if it was running as a light engine and the person in question was actually in the rear, i.e. not in control of the Loco?
2) The person was at the front in control but had stopped at a Signal or was been held in a loop. I've seen many Freight and Passenger drivers been sat reading a book with the feet on the dash, which the media seem to think is a crime...
3) What if it was Top and Tailed locos, which is common on engineers trains and the person was in the rear loco?

I'm purely going of the photograph and not by reading the Media's story here.

Having seen the original on the web:

The white light is on above the cab window. (centre cyclops light).
Train is loaded.
No signal at that point at the lineside in the picture (not to say eh wasn't stopped - the image doesn't show that, but the photographer claims it was moving, and on that line, freight normally had to keep moving so as not to delay other workings.

"I just thought I'd take a picture of the train as it looked good with the sun coming up in the background – I must have taken about ten pictures as he passed, but as far as I know he never looked up
So the photographer didn't notice the driver starring straight at the camera?

That picture in the paper is a zoom in of about 20% of the full image.......

^ Exactly!

Just watched a video of RJ's and at Stratford somebody jumped on a wagon as 66578 was pulling away, he zoomed in on him so maybe he should get a picture and send it in to the papers!

Although seriously, I doubt it has been forged, because I saw the original on scot-rail.

The original was a front/side on shot as it was coming towards the photographer but somehow the papers has got a straight head on shot, so how they managed that I don't know.

Forged or not Jord My point still stands, anyother transport industry or drivable thing the picture would of never made print. But any chance to pick on the railway is fair game. Why does the UK hate railways so much?

Oh & I loved the bit from the author of the picture, the "I had a new camera so was taking pictures of anything & just happened to take some pictures of trains on my home".. Yeah right! Closet Ned!

He said on scot-rail that he said that ^ (I can't remember everyword but something along the lines of): 'because he didn't want to bring a bad name to the scot-rail site or train enthusiasts'

You also have to understand the agenda of the Edinburgh Evening News. They are anti-everything. Nothing makes them ever report a good news story.

As for drivers, IIRC Jeremy Clarkson was photographed by the Mirror driving and on a Mobile - 2 day media wonder.

Can you not use the quote button for some reason?

Clearly trying to clear his Freightliner sheds! Stetchford is another place the locals like to scratch engines working freight trains, must be some of the top shed haulage men living in the vicinity there, they are always at it!!!

I'm sorry, but how is this a scandal? I've only seen it mentioned on the Scotsman website unless someone can point me to a link on some other news site. That seems to be similar coverage for reports of lorry drivers watching DVDs and such.

It would be very uncomfortable for the driver to have one leg on the dashboard whilst driving and playing on a PSP :|
not sure about this. I agree GhostCav - it's always train and bus enthusiasts/employees who are to blame - never car or truck drivers or people who must be so good because the drive 4x4s :(
