Delay Repay - Which TOC to Claim From

Hello all,

The train I started my journey on became delayed on-route. This brought me under the minimum connection time for a change onto the second train taking me to my destination. This connecting train, however, was cancelled. I subsequently had to wait for the next and this caused me to be 26 minutes late overall.

Although the minimum connection time was breached, I was still able to be on platform in time for the cancelled train anyway.

The two trains are operated by different TOCs and both operate 15-minute delay repay schemes - which is the one I need to claim from?

I'd personally claim from TOC 2 but wouldn't be surprised if it ends up sent to TOC 1 because some TOCs seem to consider a fouled MCT sufficient to trigger responsibility whereas some only consider it if the train was actually missed.

If TOC 1 happens to be Avanti West Coast and it does end up with them they will pay it, as I've had exactly the same.

Edit: I only say this because it may have fouled MCT but the poster did get to the platform in time for the train (which was cancelled). If it had obviously been missed (whether it ran or not) I'd definitely say TOC 1.

TOC 1, they would have fowled your connection due to the laterunning, they would have no way of knowing if you were or weren't on the platform in time for the cancelled train.

TOC 2 would most likely pass your claim to TOC 1.

I would also claim from TOC 1.

I had a similar situation with GWR running late, which meant I would have missed my TFW train at Newport. If fact that TFW train was cancelled . I claimed from GWR as they caused the first delay & they paid straight away.

I submitted my claim through TOC1 (GTR Southern) on Wednesday and they've approved it already.
