Delay Repay - two ToCs

Hi - I wonder if anyone can advise who I should claim from.

I was travelling from Cardiff to Leeds yesterday, on a 1st Off Peak return, with the intention (inc reservations) to travel as follows::

14.55 Cardiff Arr 15.30 Bristol PW
15.40 Bristol PW arr 19.03 Leeds

However the FGW train at 14.55 was cancelled and therefore I missed my connection meaning that I arrived on the following train at 20.08.

Now, the delay was 65 mins so I believe that I'm entitled to claim but do I claim from FGW (who 'caused' the delay) or XC? to complicate matters further I bought the tickets from an ATW TVM!

All thoughts appreciated.

Claim from whoever caused your delay - ie FGW.

Do they do Delay Repay yet? If not, then it would depend on the reason for the cancellation as to whether they would pay out.

FGW do not operate Delay Repay, so it will be down to the Charters.

Yes, if you are entitled to compensation, then that page calculates your compensation for a 65-minute delay on a journey where an FGW High Speed service was delayed as "50% of the cost of a return, and 100% of a single ticket."

But the page then says "Compensation will not be available for disruption resulting from events beyond the control of the rail industry, including trespass, vandalism, severe weather conditions and security alerts." So we don't know whether you're entitled to any compensation at all until we establish the cause of the delay to the 1455 Cardiff Central - Bristol Parkway on 31 March.

This is the difference between the older scheme, which excludes events "beyond the control of the rail industry" and the newer Delay Repay scheme which pays compensation irrespective of cause.

This page tells us that on 31st March 2014 the 1455 Cardiff Central to London Paddington "was cancelled throughout due to a person hit by a train (XC)". If this was due to an error by the rail industry, then you're entitled to compensation. If it was due to an external event such as a trespass, you're not.

Just to confirm, as it sounds like the delay was experienced on an FGW service, then the claim needs to go to FGW. This is a very straightforward case.

It can get more complex where you have delays on multiple operators (especially if you have a combination) but this case is very straightforward.

That's terrible to hear. Frankly the tragic nature of this has made me reconsider claiming anyway. It must have been on its way to Cardiff as my train was due to start there.

Awful, awful situation for all involved and their families.

Some on here would be doing cartwheels at the prospect of getting their money back.
