Delay Repay: TPE or Northern?

Advice please:

My TPE service was late, so I missed a connection with Northern. Normally another train 10 minutes later so there would be no Delay Repay. However, as today is a strike day, I am delayed over an hour.

So, do I claim from TPE or Northern?

It's the first TOC that has caused the overall delay. If TPE's delay had only been such that you still managed to catch your intended Northern train (had it been running), then it would indeed be Northern that would be liable. But TPE are liable for this one because you would have missed your intended Northern train even without strikes.

I have limited experience of TPE delay repay claims, so I can't say how difficult they will be about this one.

It would be useful to see the exact itinerary (booked vs actual) but based on what you've said, I would send it to TPE.

The rule is to claim from whomever caused the initial delay. There are sometimes grey areas. For example if you had a 10 minute connection and your first train was late 10 late and your second train was also 10 late. This would mean your connection would be preserved. However if your second train then became a further 20 minutes late later in its journey, it would be a bit unclear. The inital delay was still caused by the first operator, but the actual delay at your destination was caused by someone else. In general you go with the first delay, but that seems counter-intuitive there.

However, this seems to be a fairly straightforward case. You can simply use the amended timetable as the base. A missed connection by TransPennine resulted in a delay of over an hour, so you are should have no problem claiming from them.

Thanks folks. I'll try my luck with TPE. (I already have to make a claim with them for their farce around Manchester on Tuesday!)
