Debt collection agency letter received despite successful appeal

Like Dinkiburns a letter from a debt collection agency (am I allowed to name them?) was delivered yesterday (20th April) - don't you just hate these arriving at the weekend when nothing can be done until the Monday causing no end of worry over the weekend.

Anyhow, they allege that one of my children owes just over £53 that must be paid within 7 days - I have to say that the content of their letter was a little threatening (could be 'named in the local paper'). Background - one of my children had travelled on Merseyrail on 6 Feb without their term pass and when they realised went to a Merseyrail member of staff to explain and offered to pay for the journey. Unfortunately, as is standard procedure a £20 FP was issued, minus £3 fare that was handed over, leaving £17 owing. The staff were very nice and said to appeal enclosing a copy of the rail pass and the FP would be cancelled and £3 would also be refunded. The appeal was successful and the letter said the fare would be reimbursed. However, this has not been forthcoming. The Merseyrail FAQ given to my 'child' clearly says that failure to pay or failure to successfully appeal would result in Merseyrail sending a reminder letter - this was never received.

A carefully and appropriately worded email has been prepared to send to the DCA, with a copy going to Merseyrail tomorrow morning. But my pleasure will be when I ring both companies before posting just to let them know what I think .... Make sure you keep it civil and stick to the matter itself. It is not really worth the aggro and there is no point sinking to their level.

As you have already appealed successfully, you can rest assured that the matter will be resolved eventually, otherwise someone could look very silly in a court. ;)

What's wrong with being polite and ringing Merseyrail tomorrow morning? I'm sure they could sort it out in minutes, without you resorting to letter writing or getting irate.

Just double check the references are the same, i.e. a second Penalty Fare could have been issued for a different incident.

The most likely cause is a simple database error.

Ultimately, it is a simple oversight that hasn't caused any real harm, and will take all of 2 minutes to resolve.

Overreacting?

Merseyrail use Daniel Silvermans:

Working with Daniels Silverman we have doubled our debt recovery collection rates in the last 18 months by taking a much tougher stand with offenders. This includes: contact by phone, SMS text messaging, stronger harder hitting letters and visits in person. We have also increased the administration charge, added to penalty fares. Daniels Silverman are really persuasive in encouraging people to settle their debt and make payment easy, for example their online payment facility is a popular method for payment. It is important for train companies to take enforcement action so fare costs can be kept to a minimum for over 98% of honest people who pay for their tickets. Merseyrail re-invest this recouped revenue in improving the security of its stations.

I have no experience of phoning Merseyrail, but with certain other TOCs it has taken a damn sight longer than 2 minutes to even get through to someone who can understand what the issue is !

They appear to have a dedicated Penalty Fare helpline.

The most likely cause is simple human error.
Corrected that for ya! ;)

It's less likely that a database would go wrong - and far more likely that the human employed to type stuff into the database got it wrong.

Agreed, rarely the system and often the people that use it at fault.

Rang Merseyrail and spoke to a delightful young man. He said that this shouldn't have been passed to the debt collectors since the account was on hold and a reminder still hadn't been sent (as is their procedure).

Also rang debt collectors and emailed scanned 'debt denied' letter, as they requested. I also received a 'read receipt.'

My conversations with both parties were extremely professional, polite and to the point, as is always my style. (I never get irate!!)

For those of you who may find yourselves in a similar position - train companies accept that folk occasionally forget to carry their documentation and upon production of a valid season ticket may revoke any penalty fare .... however they will only do this on two occasions within a 12 month period.

And my advice is ALWAYS keep copies of letters you send and receive - you never know when you'll need to refer to them.

Thanks for the update, I;m glad the issue has been resolved. It's very good advice to always keep copies of correspondence too.
