Data Protection Act and Itemised Billing

Does anyone know whether it is an entitlement under the Freedom of Information Act for the subscriber to receive records a phone company holds about him with regard to calls, texts and data usage, with the payment of a small admin fee?

If so, how far back can this go?

The Data Protection Act holds such a provision, however its my understanding the data processor is only obliged to provide the data it holds. Whatever retention period it has decided on will be the maximum available, ie 'whatever it holds it must provide'.

The maximum fee under the DPA is £10.

I thought the freedom of information act only applied to public bodies. I don't think you can apply it to other organisations such as businesses.

To try and clarify, the Freedom of Information Act applies to public bodies only, the Data Protection Act applies to all.

I assume we are talking about the DPA here?

If the company holds information about an individual, the DPA does indeed apply.

I believe it's likely bb21 simply typed FOI instead of DPA by mistake - such mistakes are easily made, especially if you've just made a load of FOI requests!

Yes, the DPA means they have to send you everything. They usually take their logo off the paper so it is useless for ID.

Would it not be classed as a SAR (Subject Access Request)? I've had to do this at work when customers have phoned in to see what information we hold for them which usually costs the customer £10...
