Criminal record?

Hello,

Two years ago I was caught without a ticket by an RPI and received a letter asking me to pay a penalty fee of £50 in addition to the price of the ticket. I paid this immediately along with a letter of apology and then received a letter from the train company (Virgin) saying the matter has been resolved without prejudice. I use the trains regularly and would never do this again it was a stupid mistake for which I am truly sorry.

I am now in the process of completing pre-employment checks for a new job (my first new job since the event) and have to complete an enhanced DBS. I am now extremely worried that this will show up on my DBS and I don't even know if I should declare any reprimands,warnings or cautions as it asks for because I don't know if I have one! I would really appreciate any insight into this matter as I'm currently driving myself crazy with worry about it. Are these events recorded on the police national computer?

It appears you agreed to settled the matter with Virgin directly, therefore there was no court case, no conviction and no criminal record.

Someone who was simply found to be not in possession of a ticket when travelling on Virgin Trains would - unless there is something suspicious going on - normally be offered the chance to buy an Anytime* ticket. So I'd guess the £50 extra was probably either added because of late payment, or maybe there was evidence of an attempt to avoid the fare, but as the matter was settled it never went to court.

(* Unless, of course, there was no opportunity to buy at the origin station, in which case the full range of tickets would be offered)

I agree that the incident referred to will not appear during a DBS search.

The Penalty paid is a private, commercial, transation between yourself and the Railway Company, and none of the databases used by DBS could be aware of it.
Even an enhanced DBS check cannot find your commercial transactions.

As it was two years ago, it's safe to say you can forget about it. As long as you buy tickets in future, the event with Virgin will have no effect on the rest of your life.

As for the 'caution' bit, this isnt where the Police, RPI read you your rights, but when you are 'invited' to the Police station to be told not to do it again which didnt happen in your case so has no relevance.

What has happened in your case is a private matter between You and Virgin so there is nothing to declare.
