Conversation regarding Dodgy Delay Repay Claim

My grandson has just been telling me about a full blown argument between a passenger & the guard on his train yesterday. The passenger was travelling hours early on an advance ticket but refused to pay in a heated argument for a new ticket when the guard was checking tickets, the guard walked away in the end without taking it any further. The train was then delayed & a second argument started between them with the passenger demanding Delay Repay compensation on the basis that because the guard walked away without charging him he was eligible for it. Grandson left at the next stop so don't know how it played out but surely people aren't stooping to this level of "technicalities" to pursue a claim.

Regardless of if he was entitled to it or not, I can't see why he was arguing with the guard - it's not like he would get the RTV there and then!

Can't see him getting very far with that one when he has to submit the ticket to the TOC to verify his claim unless the train that he should have been on was also delayed sufficiently to qualify for the delay repay claim.

The guard will argue that he walked away from the situation because the customer was becoming aggressive towards them. I might have done the same if I wee the guard. In order to qualify for delay repay, you have to have a valid ticket. In this case, it sounds like the customer did not have a valid ticket so, even if they submit a claim, they did not have a valid ticket for the delayed service so will not be getting any compensation.

Indeed, could they submit the claim, with the invalid ticket and details of service travelled on enclosed, the guard submit a report of the behaviour and a prosecution ensue?

How likely is it that anything will come of it though? Would they simply reject the claim rather then going down the road of prosecuting?

Depends on the exact circumstances , the TOC concerned, and - crucially - any evidence gathered/supplied surely?

Would be funny if they responded with an invoice for payment of the correct fare, and advising that upon payment of this we shall gladly process your delay repay claim.
