Sat opposite me on the 1700 Kings Cross to York is someone who had no ticket and only an electron card so now they have an unpaid fares notice. If the train is delayed by more than 1 hour and they pay the UFN can they claim under delay repay to get the ticket cost back in vouchers?

A UFN as long as paid within timescale is just an invoice, so should see no issue with delay repay

Train was delayed by over 90 mins, guard came round to a passenger who said to the guard, "you could sell me a ticket" but I would claim it back. The guard then responded by saying he would save the guy the bother and moved on!

I've done this, both with full tickets and 1st class upgrades before now for that reason. Although by doing so I am doing myself out of commission.

Just make sure you send them a cheque and claim form in the same envelope so they can just send you the cheque back. ;)

Or is that too optimistic?

I appreciate that one would have to pay the excess first and claim it back but still.

Sadly both Virgin on the West and East Coast tend to run near enough to time but if there was a breakdown . . . .

I doubt it as you would have been aware of the delay before you bought your ticket or excess/ weekend upgrade in this scenario.

No point trying this on Virgin anyway - 1 hour late = 25% back, 2 hours for full refund!!
Great company, but mean.
East Coast 30 mins late = 50% refund, 1 hour = 100%

Well they're only doing what they have to do by the NRCoC whilst East Coast are under the new measure called Delay Repay which is far better for (most) passengers. So it's not total meanness. (or East Coast being really nice). Eventually all TOCs will be using Delay Repay (and I think I've heard somewhere that VT might be moving to it as part of their extension but I'm not totally sure).

If you write a letter of complaint listing all the delays and problems you are far more likely to achieve a lot more than 25%.

Seems like the reasonable thing to do, as long as any other staff relevent are made aware so as not to get the passenger in to bother when they reach their destination, which unfortunately happens all too often...
