Hi all, thank you in advance for any views. This is a 'prospective dispute', facts below.

Travelling via Manchester Victoria to Liverpool Lime Street. Two legged journey, first one with Northern via Rochdale. Second leg on a TPE service arriving at Lime Street for 2pm, wedding starting at 3pm.

It may not be relevant but when booking yesterday the TPE service arriving at 1pm had already been prospectively cancelled.

We had a 30 minute changeover at Victoria. The service was cancelled about six minutes after it was due to depart, so approximately 13:30. Passengers were advised to take a Northern at 14:07 to Chester and change at Newton-le-Willows. Obviously that was not appropriate to our time sensitive appointment.

After checking there were no alternatives from Picc/Oxford Road, it appeared the next best option would arrive at 15:30. Had we been advised in advance we might have manged to catch a delayed EMR service from Piccadilly.

Therefore we took an Uber which is due to get us there with 15 minutes it spare.

You can see where I'm going - what are the prospects of a recovery from TPE for the taxi fare after journey abandonment?

Thanks again in advance for any views.

I think you'd be looking at a goodwill gesture only. TPE didn't abandon you as there were other services available so whilst your course of action was reasonable what with the time sensitive nature of your journey I can't see that there's any entitlement to fallback on so you're just hoping that whoever deals with your correspondence is feeling generous!

Is it possible to have a partial refund due to disruption and journey abandonment?
If you only make part of the journey, yes. There would be no administration fee in the case of disruption, but the calculation of how much refund was due could be contentious (e.g. the retailer may argue it should be the equivalent fare to the station where you abandoned your journey, whereas you may argue it should be proportional).

So how much disruption is required for a partial refund? If there is a single cancelled train on a line running every 15 minutes, and I abandon the journey due to that train being cancelled and use a local bus home, am I entitled a refund?

There is no threshold defined in the NRCoT. Given that a delay of as little as 2 minutes can make the difference between a connection being made or lost, I don't think there can really be any appreciable threshold.

That said, there is a minimum threshold of 61+ minutes' anticipated delay before your rights under the PRO kick in. In some circumstances these are more generous than those provided by the NRCoT.
