Compensation against cancellation

Hi Guys,

I tried travelling to Newquay today from Plymouth. The service had been suspended mid journey and my connecting train from PAR-NQY was cancelled. Alternative transport was available (Taxis/buses) from PAR but i'd miss my appointment and it'd be difficult getting home again in case there was another incident between PAR - PLY so I decided to return back to PLY.

FGWs Pax Charter says they will compensate against any train cancellation, but the amount of compensation given is dictated by "How long it took the next available train (or alternative transport provided by us) to arrive at your intended First Great Western Destination"

Now, because i chose not to proceed to my destination; am i entitled to any compensation?

TOC's usually operate a delay repay system, normally if you are delayed by 30 mins you will get 50% of your fare back for a single or 25% for a return

If you are delayed by 60 mins plus you will get 100% of your fare back for a single or 50% for a return.

I don't know how first administer delay repay but on GA the passenger needs to fill out a form (available from most manned stations) and detail which service you were delayed on and submit your tickets with it.

If you choose to abandon or cancel your journey due to delays, you must hand in your ticket immediately to a booking office to be eligible for a refund, according to the NRCoC.

FGW don't do Delay Repay.

island is correct in that, per the NRCoC, you must hand in your tickets as soon as you decide not to travel. That said, I'd email customer services explaining what happened (mention how late you would have arrived at your destination if you know), and I'd be surprised if you don't get something.

Only about half do. The rest don't operate 'delay repay' yet, which is the comparatively new system, and therefore they don't necessarily compensate under every circumstance outside the railways's control so 'usually' is probably the wrong word...

That is not Delay-Repay, as it says "Compensation will not be available for disruption resulting from events beyond the control of the rail industry". A key feature of Delay-Repay is that compensation is paid irrespective of these things, unless the disruption was known when the passenger purchased the ticket.

"Delay Repay" is a specific scheme which is essentially identical between all TOCs which subscribe to it (LM, XC, EC for example). All TOCs will give compensation for delays caused by events within the Railway's control, as required by the NRCoC.

DR is much more generous to the passenger than the obligatory compensation, both in amount of compensation paid and the circumstances in which it is paid.

I dont have my NQY-PLY ticket as it's in the gateline at Plymouth. But i do have my PLY-NQY Ticket. I'll email FGW and see what they say.

As you have started the journey, you won't be able to get a refund on those terms.

Also, as the journey was effected by flooding, you won't receive any compo.

However, you may be entitled to claim for the stretch between Par and Newquay as you didn't travel that far, but I wouldn't get your hopes up

Given you knew you'd need the ticket as you gave up the journey it does baffle me that you inserted it into the gateline?

Well I didn't know i'd actually need it (I didnt have the compo leaflet at the time and it's the first time i've ever actually had a train cancelled on me) and to exit the station you need to put your ticket into the gateline. I didnt think to speak to the gateline staff at the time. To be honest guys it's more of a fact finding mission than an actual wanting to claim. With my AFRC it was £11 return. Hardly a bank breaker ;)
