Claim after involuntary reroute

For travel on 4th November I bought from TrainSplit a ticket Angmering -Chichester-Southampton-Salisbury-Warminster- Newpor—Cwmbran- Shrewsbury-Hope-Heswall. All were first class where that was provided.

Arriving at Angmering I was informed that due to rail damage in the Fareham area the initial part of my journey was cancelled. I was therefore rerouted Angmering-Gatwick Airport- Reading-Newport.There was no problem over the tickets being accepted and I expected to resume my original schedule at Newport where I was programmed to arrive on the GWR 1142 from Reading-arriving at 1301 and connect to the Transport for Wales ( TFw) 1307 onward to Shrewsbury. This rerouting was successful until the GWR train from Reading was delayed and arrived at Newport 16 minutes late.I failed to make the planned connection and was rerouted to the TfW 1334 train .This 2 car train had only standard class accommodation

I claimed refund of the difference from TfW between first class and standard class fare paid between Newport and Shrewsbury.TfW have now advised that I should direct the claim to GWR as the late running of their 1B12 into NWP was the root cause of my claim.

I’d appreciate thoughts on whether this claim falls under delay repay or falls under a different type of claim.

For situations such as this, the best thing to do is to type out the full itinerary as booked, followed by the full itinerary as actually happened, both in list format (see this example). It can also be useful to list all ticket(s) that were used for the journey.

If you were delayed by a qualifying period into your final destination (in this case, that would be 15 minutes late into Heswall), you are entitled to claim from the first train company that caused a material delay.

In this case, although there was disruption affecting GTR services, you did make the GWR connection, and it was GWR who caused the delay, so GWR are liable.

I agree with TfW; it was GWR who caused the missed connection, which resulted in the delay, and therefore GWR are liable to pay compensation

If the train you caught was booked to convey 1st class, but it was declassified or didn't exist on the train, then TfW would additionally be liable for compensation in respect of that portion of the journey, however I suspect in this case the train you caught was never booked to have it, so there is no claim with TfW, only GWR.

In this circumstance would a passenger be entitled to wait for the next train which did convey First Class and claim Delay Repay in line with the even later arrival time at their destination ?

They would be entitled to be rerouted in "comparable transport conditions" so I would say it's clear that if first class is what's booked then first class on a later service is indeed comparable.
