I believe it was RoR. I have a picture of the letter on another post if that's what I can link to.
Ah yes, I just merged everything into one thread so I can see it now.

It's Section 5.3(a) of the Regulation of the Railways Act. This means the conviction will appear on a Basic DBS until it is spent which is a year. In some limited circumstances it might be disclosed for a longer period of time.

A conviction for a railway ticketing matter wouldn't normally impact career prospects but my advice is always to be honest with any potential employer about what has happened rather than letting them find out afterwards.

Ah okay, thank you for that! How does it work with an enhanced DBS? How can I check all of this? I've gotten into another role, but it didn't require a DBS. My concern is that I'd like to relocate overseas, so I'm unsure of this effecting the move.

The offence will show on a standard or enhanced DBS check for 11 years from the date of conviction. After that time, if it's your only offence, it will be "filtered" (removed) from the certificate. It will never disappear from an ACRO, which is the form of police "good character" certificate issued for people applying for visas to other countries.

As it's more than a year since the conviction, it will have already dropped off Basic DBS certificates.

There are three somewhat separate questions - what the Rehabilitation of Offenders Act permits employers and others to ask for UK purposes, what is disclosed by various DBS checks, and what foreign governments require from people wishing to enter their country.

Any conviction punished by a fine is “spent” for the RoOA 12 months after the date of the conviction. Most employers and others in the UK are not entitled to ask you to disclose spent convictions. There are, however, exceptions where this restriction does not apply.

Most offences which cannot be punished with imprisonment are not usually ‘recorded’ and are unlikely to appear on any DBS checks. Regulation of Railways Act s 5 (3) (a) has a theoretical possibility of a sentence of imprisonment so this will be recorded and returned on DBS checks.

How these two, and the concept of filtering for DBS checks, interact is more complex than it should be.

Neither of these change the position in relation to other countries. A person who wishes to enter another country must respond accurately and honestly to any enquiries and read the conditions of any application very carefully.
