Caught With Expired Railcard

Hello there - before I get into the details, I know that what I have done is wrong and I am pretty ashamed about all of this. My financial situation has been pretty poor this year, which contributed to me knowingly travelling without a valid railcard. I am a former UK resident (late 2021-Jan 2025) who became ineligible to renew the railcard as my visa was ending, but I have been visiting London from time to time this year to crash with friends. My most recent railcard expired in December 2024. I've been pretty ignorant to how severe this is, though I know this is not an excuse.

The Incident
I was caught with an expired 26-30 railcard several days ago at London Gatwick on a Thameslink train bound for Horsham. I boarded with an invalid ticket with open return to London Blackfriars that I purchased with Trainline.

I was pretty flustered during the interaction with the inspector, but I'll stick to the stricter details of our interaction:
  • I did admit to knowingly travelling this instance with an expired railcard
  • He took pictures of my invalid ticket and the email that detailed my Railcard
  • I gave him my prior occupation, instead of my current – I am actually unemployed
  • I provided him with a trusted friend's address as I am out of the UK more often than not
What now?
I am, of course, ultimately waiting for the letter to arrive to my friend's address. I know they will likely interrogate my Trainline account, which will show 5 journeys that I have taken since the Railcard expired.

Based on the above, how screwed am I? Ideally, I would like to try for an out of court settlement, but I know that this is ultimately up to the railway. Could anyone offer insight or advice?

Is this with GTR Thameslink railway?

Almost certainly possible to settle out of court if you engage with them in next steps of this.

Only issue I can see will relate to you safely getting their letter which might be some weeks away if you are not then in uk or if your friend moves address. Is that likely eg in next two or three months for example.

So you could buy one now if it will help with future travel so long as you meet the relevant criteria for railcard. Eg age if applicable.

Thank you so much for your response. My witness statement receipt indicates that this was with Govia Thameslink Railway. My friends will not be moving away anytime soon, so I am not hugely worried about not receiving it (unless they're away for the winter holidays?).

That's helpful to know. I had assumed that the Railcard was only for UK residents.

It's worth emphasising to your friend/s that you are expecting urgent, time sensitive correspondence; one of the main causes of these issues escalating is when the railway company believes you are failing to engage e.g. by not responding by a deadline stated in their correspondence.
Also mention to them that although it will be time sensitive for you to respond once it arrives, it may not arrive for some time.

When you reply to the letter I’d be a little circumspect about mentioning some of the points you raise here in mitigation as they do appear somewhat contradictory.

I would imagine reading in mitigation that someone has a poor financial situation and is unemployed but still manages to find the money to fly in to visit friends in the U.K. regularly (just not pay the full rail fare) wouldn’t particularly help your case.

I've certainly let them know and I'll be actively trying to monitor the situation

Thank you for your input. I agree with you. I'm not interested in detailing everything as I have done here. My situation is pretty unique, so I agree that I would not be looking to describe in full detail what it is.

I think that I am likely to keep contextual details to a minimum in my apology letter, and simply acknowledge that my personal financial situation did affect my judgment in an adverse way.

This sounds like the right approach in general

see other threads with GTR Thameslink to get the idea of what will happen and responses people send - when you get the letter you can return here for help with the response and / or checking what you plan to say in a draft before you send it.

ref a new railcard - next time you are passing a station pick up the paper leaflet about railcards and have a look over the application form included in it - you can check what they want to ask for but I think it's fine for any sort of visitor to the UK to buy one.

If you do buy one it is something you can say to the railway you now did to 'show you had put things write for future travel' after you were stopped, as part of your mitigation request reply that you will have to send when you get their letter - though if you are no here for long it may not make financial sense to buy one.

Hello again. Thank you all for your help so far. GTR's letter arrived this morning:

How does the below draft read? I did indeed purchase a new Railcard, but obviously would not want to self-incriminate for the five other offences that took place in the nine months between the two Railcard validity periods.

I wouldn't have thought what you propose ref the signature would cause a problem at this stage of the process.

I think that’d be fine. Will your friends have access to post at the address GTR will write to?

Yes, I think that they will be okay with sending it off for me.
But will they be able to monitor post at that address for you? It’s really important that you have access to their response promptly

Hi, yes, thanks for your continued attention to the matter. They have been monitoring their mailbox for me as is and signalled me when GTR mailed me in the first place. They will be able to continue to monitor in the event that GTR replies by post.

Sounds good - I think there is a strong possibility GTR will still reply by post (possibly even if you have asked them to reply by e-mail) - but you clearly have a plan in place.
With luck they will respond and offer a settlement then you will have to pay it in full in a fairly short space of time in line with instructions in what they send you.
