Pleading guilty to a crime or being convicted of one after a trial means a person has been convicted of that crime.

Railway ticketing crimes are punished by fines. This means that where the Rehabilitation of Offenders Act concept of “spent” convictions applies the conviction can be ignored when answering questions etc from one year after the date of the conviction/court hearing. This Act applies in most British circumstances but not to sensitive jobs and professions, and not to other governments and organisations not subject to British rehabilitation law. Where the Act applies, it is honest to answer “No” to a question about convictions if any and all convictions are spent. Where the Act doesn’t apply, that would be dishonest.

Most railway convictions apparently do not get recorded on the main computer systems used to compile criminal records checks. That doesn’t change the fact of the conviction, though. The right question to consider is usually “do I have any disclosable convictions in this context” rather than “will anything show up on a criminal records check”.

Differences in severity are dealt with by the way in which an employer or other person would respond to disclosure, and by different rehabilitation periods depending on the nature of the sentence. As the sentence will be a fine this will signify a low-seriousness offence to anyone who considers it.

Hi everyone! One of my daughter parent from school! She is same situation! She used her dad ouster card60+! She doesn’t speak a good english, and her understanding is not perfect aswell! Anyway she got same later what she did reply guilty and also did apologise was her first time!Today she got letter she will be invited to the court! She is devastated! If anyone went through this can give some advice please! Really appreciated

Please start your own thread. No two problems are exactly the same and good advice for one may be bad for another.

Oh no. From reading the replies it doesn’t look too promising :(

Can someone help clarify what implications there are if they prosecute me. Does this mean a criminal record, and will it show on searches done by employers.

Apologies if the question has been answered, but I just want to be sure and find out if the prosecution is treated in the same manner compared to a much serious/violent crime such as assault would be.
May I ask what happened next? Are you able to pay the fines without attend hearing?

By way of an update, I just received a call from my solicitor (Shella Makwana) who has let me know the good news that TfL will be issuing me a warning on this instance.

I will follow up on this thread with more details of the response when I get the email, but I thought I would share the news here.

Just wanted to thank everyone on this forum who took the time to read and provide responses to my matter. I greatly appreciate it.

Not to mention my solicitor, Shella. She was great throughout the whole process from guiding me in my initial response as well as the follow up response.

Thank you for the update. Another case then where use of a solicitor has the desired effect with TfL whereas otherwise we'd be very surprised if there wasn't a prosecution. It would certainly be helpful to know how much the solicitor's fee was if you don't mind sharing it.

Can you tell me in what capacity did you use the solicitor? I see they have a 1 hr consultation for about £300. And if you want them to write the letter, another +£750… hefty prices! So I want to see what other did.

Also, did you admit you’ve done it in your communications with TFL?

I’ve been told apologizing and admitting would lead the case to the court!
