Careless driving charge

Hi Guys,

Looking for your opinion here, I'm waiting on a start date from network rail passed my medical and all other pre employment checks but to my surprise a careless driving charge has came back on my basic disclosure, now the lady from recruitment said this should be ok I received 3 points and a £200 fine last year, went into the back of someone at 15MPH my fault as the car Infront was stationary so someone had to take the blame. I didn't disclose it as I did not think this would be on my record as it was minor! Would this affect my employment ?

Surprised that resulted in a charge. It happens all the time and is mostly just down to insurance.

Yes the police were on scene that's how I got charged ...... Bit of a joke tbh if I thought it would be on my record I would have disputed it .

Just found that on the interwebz. You can check your the vehicles you can drive (Categories) and any endorsements. Some quick research also led me to find that although driving without due care and attention doesn't specifically lead to a criminal conviction (other circumstances need to apply) It is held on the Police National Computer and should be treated like an unspent conviction. There is also disparity between how long it remains on your license and record, which may catch people out and I think has been discussed on this board before.

Surprised this showed up in a basic disclosure to be honest. Did they specifically ask about driving offences?

As far as I’m aware careless driving is non-recordable? Dangerous driving however, is and attracts harsher penalties (similar to drink driving).

Did you go to court or was it issued by the roadside? If it was issued as a ticket by a police officer I'm amazed this has shown up on a disclosure.

The police were at the incident and said I would receive a letter asking me to attend court.
A lawyer attended for me, 3. Points and £200 fine.

I think this is why it showed up, would this affect my employment in your opinion ?

I’d say probably not. If it’s specific what the offence is on your disclosure I wouldn’t think they’d be that bothered by it.

So from a bit of research a careless driving conviction at court would be on your record for one year and be considered spent after that year. So if the conviction was within the last year it is considered unspent. It all depends as to what the question on your application form was. Some only ask for non driving convictions with the obvious exceptions. If it asked about any unspent conviction you should have declared it. Can you remember how it was worded?
In my opinion it shouldn't affect your employment as long it was as minor as you described.

Wouldn’t worry about it happened before you started and let’s face it it’s not exactly crime of century.Could be a different story had you been employed and driving there vehicles.

I wouldn't have thought it mattered. Most jobs I've seen that involve driving allow up to 6, an extreme 3, points on your licence. Though I asked my present employer what theyd do if they employed someone on zero points and they then got to 6, nothing was their answer!

Unless whatever role you're doing wants zero points I'd ignore it.

The points only matter if the job involves driving a company vehicle usually (not including a train ).

You'll be fine and it's something that a lot of people get caught out with when filling in job application forms. I'm surprised you got 3 points for the accident actually - was it a traffic unit that dealt with it (they have white caps)?
