I am happy to confirm that FCC decided to withdraw charges prior to trial, and were ordered to pay towards my costs. In my personal opinion this was more to do with the expertise of Gary Edel of Penman Johnson (
www.penmanjohnson.com) as the particular merits of this case. (though there were those too!) I believe that the same facts in the hands of another lawyer may well not have secured this outcome. Gary Edel is very experienced in particular in the protocol and method of this kind of case. I recommend that you read his profile and cases. It seems that faced with such a potentially protracted and expensive defence, FCC opted, after argument from Gary Edel, for a cheaper and faster resolution to their prosecution against me, by withdrawal of the prosecution case against me. An Application was made to the Magistrates for my Defence costs, which was granted. But it is hard to put a price on a criminal record, and in my case it could have seriously affected my career. I am more than happy to recommend Gary Edel to any forum users looking for help with a similar problem. My initial consultation was £90.
