Any way of getting out of this?

Just got fined on a train for having the wrong saver card, a 40 p difference, the guy said he’d give a warning than said to appeal a fine, which has happened to me before and great northern do nothing, any way to get out of it I really don’t wanna pay this, especially as I was fined this month already and the ticket man was generally being a unhelpful and should’ve let me be fine? Have u had any ways of getting out of these situations?

It would be helpful to see redacted copies of any paperwork you have been issued with.

Have you been issued with a penalty fare? Just to explain that this is the correct proceedure for a ticket irregularity. The alternative would be a report for prosecution, which would be much harder to 'deal with'.

There is a reasonable chance that, if we can look at the penalty fare notice, an expert may find a reason why it is not issued in accordance with the regulations i.e. give you a grounds for appeal. This is likely to be your most successful route of appeal.

Which railcard did your ticket have applied, and which railcard (if any) do you have? Just to explain that a ticket with an incorrect railcard discount makes it totally invalid - therfore you have travelled without a valid ticket which is fare evasion, effectively theft.

It may be useful for us to know more about previous instances you've been stopped for fare evasion. You've come off well to have a penalty fare, and not a report for prosecution, more common for repeat offenders.

If it's railcard issues that you've been stopped for before, then you need to either pay more attention if it's accidental or stop trying your luck because one more time and you may find yourself in court.

As above the most likely avenue of appeal is on technical grounds as there are some quite strict regulations on penalty fares. So please upload what you were given by the guard / inspector.

I feel like you don't understand the potential consequences of your actions here. Fare evasion is a criminal offence. It doesn't matter whether you want to pay it or not, or how nice the member of staff was or wasn't; fare evasion can either cost you financially in the form of an out of court settlement (excluding TfL), or it can land you with a criminal record. Are you really arguing about 40p when you've already been caught this month and those are the risks? Pay up and stop fare evading.

However, as SECR 65 has noted, there may be a chance that the notice was issued incorrectly. But we won't be able to tell you unless we can see the paperwork.

And regardless of what action you take now, you are now on the train company's radar, so if you come to their attention again, they may not be inclined to be lenient.

You were travelling without a valid ticket. If you were prosecuted - which if you carry on like this you will be - a guilty verdict is automatic. Buy the correct ticket and pay the correct fare.

It would help if you could explain a little more calmly exactly what happened.

What company was involved?
What "saver card" did you have? What "saver card" should you have had?
What paperwork were you given?

I had a 16-25 saver card, not knowing they had any difference I pressed 16-17 thinking I had that one and was given a “warning” an orange reciept where I was told to appeal it, so not a warning at all , has happened before, do I actually get fined if they don’t accept the appeal, if so that’s not a warning

I feel it is important to highlight that, realistically the only chance of appeal is if the penalty fare was not issued in accoradance with the regulations, for which the experts on here need to be able to see the paperwork so they can advise.

In your opening post, you stated: "...especially as I was fined this month already".
1) Do you mean you received a Penalty Fare earlier this month, as well as the one you've received today?
2) What reason were you issued a Penalty Fare earlier this month? Using a 16-17 year old railcard discount but you have a 16-25 railcard? If yes, then why did you persist in using the wrong Railcard when buying your tickets?
3) Did you pay the Penalty Fare issued to you earlier this month?

The train company are unlikely to believe you, as the 16-17 gives you an extra 1/6 off the adult fare and has other benefits.
Are you under 18 BTW?

I find it somewhat hard to understand how, having been previously "fined" for selecting the wrong Railcard (16-17 as opposed to 16-25), you then say that you thought that the former, which "coincidentally" offers bigger discounts, was the correct one.

Be cautious what you wish for. They could easily drop the "fine" (actually almost certainly a penalty fare) and prosecute you instead.

It could be a penalty fare warning, which is most likely.
